mesothelioma-asbestos-lawsuitA North Carolina resident recently filed an asbestos mesothelioma lawsuit, alleging that he suffered thirty years of exposure to asbestos fibers that led to his cancer diagnosis.

Plaintiff, James H. worked for nearly thirty years as an employee of Carolina Power & Light (“CP&L”), which merged with CBS Corporation.

The asbestos cancer lawsuit claims that he was diagnosed with mesothelioma as a result of his exposure to asbestos while working at CP&L.

James alleges that his time with CP&L regularly involved working with equipment containing asbestos. According to the asbestos lawsuit, James used this equipment when cutting, sawing, drilling, and other activities, which created dust and released dangerous asbestos fibers into the air.

As a result of this alleged asbestos exposure during work, James was diagnosed with malignant mesothelioma in April 2015.

James’ mesothelioma diagnosis has led to physical, mental, and emotional pain and suffering, as well as serious medical expenses. He has filed the asbestos mesothelioma lawsuit on multiple counts, including negligence, willful, wanton, reckless, and gross negligence.

According to the asbestos cancer lawsuit, the company was aware (or should have been aware) of the dangerous nature of their asbestos-containing materials before and during the time that James worked for them. Not only was the defendant aware of the presence of asbestos, but also its ability to cause disease and even fatalities.

The asbestos lawsuit alleges that, for these reasons, the plaintiff’s asbestos exposure and subsequent diagnosis was foreseeable and should have been anticipated and avoided by the defendants.

Essentially, the defendants knew that their equipment, used by their workers, contained asbestos and was harmful and potentially fatal to those exposed to its fibers. The defendants allegedly failed to warn their workers of the damaging and possibly fatal consequences linked with the use of their asbestos-containing products. James also seeks punitive damages for the defendants’ reckless, willful, and malicious conduct.

Asbestos Mesothelioma Cancer

Mesothelioma is a cancer that attacks the lining of the lungs, and has been primarily associated with exposure to asbestos. Asbestos cancer takes decades to develop, but quickly spreads to distant organs. Because of these factors, asbestos mesothelioma is commonly diagnosed at a late stage of development.

Asbestos is a naturally occurring mineral used for commercial purposes such as electrical or building insulation, as well as countless other uses. Asbestos’ microscopic fibers can accumulate in the lungs and cause several critical health problems, the worst of which is cancer.
