An asbestos mesothelioma lawsuit was filed by a Georgia couple in June against Motorola, claiming the company failed to warn the plaintiff of asbestos risk.
The asbestos mesothelioma lawsuit claims that Plaintiff Earl F. was diagnosed with malignant pleural mesothelioma as a result of “actions and inactions” of Motorola.
Malignant pleural mesothelioma is a fatal cancer that is extremely debilitating. The disease affects the linings of a patient’s lungs.
According to the lawsuit, the only known cause of malignant pleural mesothelioma in North America is exposure to asbestos.
Earl claims in this asbestos mesothelioma lawsuit that he was exposed to asbestos while working with Motorola, from asbestos-containing products or equipment.
According to the asbestos mesothelioma lawsuit, Motorola either knew or should have known first, that its products or equipment may have contained asbestos, and second, that they would then be used without proper inspection.
The lawsuit alleges that Motorola had a duty to inform Earl and other workers about the possible risk of inhaling asbestos fibers, as well of the risks involved in that exposure.
However, Earl claims that Motorola failed to inform him of the dangers inherent in exposure to and inhalation of the asbestos fibers in their products or equipment.
The asbestos mesothelioma lawsuit was filed on multiple counts, including negligence, product liability negligence, loss of consortium, and punitive damages.
Earl’s asbestos mesothelioma diagnosis has led to physical, mental, and emotional pain and suffering, as well as significant medical expenses, the lawsuit alleges.
Asbestos Mesothelioma
Mesothelioma is a cancer that attacks the lining of the lungs, and has been primarily associated with exposure to asbestos.
Because of this, construction workers make up a large number of those who file asbestos mesothelioma lawsuits, as they have often spent years surrounded by products and equipment made with asbestos without proper protection or even warning of the dangers of such exposure.
Asbestos is a naturally occurring mineral used for commercial purposes such as electrical or building insulation, as well as countless other uses. Asbestos’ microscopic fibers can accumulate in the lungs.
Asbestos lung cancer takes decades to develop, but quickly spreads to distant organs. Because of these factors, asbestos lung cancer is commonly diagnosed at a late stage of development, which makes it significantly more dangerous for patients.
Filing an Asbestos Mesothelioma Lawsuit
According to this asbestos mesothelioma lawsuit and others like it, the company the plaintiff worked for was aware (or should have been aware) of the dangerous nature of their asbestos-containing materials before and during the time that the plaintiff worked for them.
Many people exposed to asbestos, often construction workers, have filed asbestos cancer lawsuits after being diagnosed with mesothelioma.
If you or someone you know has been diagnosed with or died from an asbestos-related disease, and have been exposed to asbestos, you may be able to file an asbestos mesothelioma lawsuit.
The Asbestos Mesothelioma Lawsuit is Case No. 16A60479, in the State Court of Dekalb County in the State of Georgia.
