Apple haApple class action lawsuits agreed to pay $53 million to settle a class action lawsuit accusing the company of refusing to honor its warranties for damaged iPhones and iPod Touch devices based on its assessment that they made contact with water.

The Apple warranty settlement will provide cash payouts of potentially several hundred dollars to hundreds of thousands of iPhone and iPod Touch consumers who were unable to have their faulty devices repaired or replaced under Apple’s standard one-year AppleCare warranty or two-year extended warranty, according to a Settlement Agreement signed by Apple’s chief litigation counsel on April 10, 2013.

The settlement will resolve allegations raised in multiple class action lawsuits (consolidated as In re Apple iPhone/iPod Warranty Litigation) over Apple’s former “Liquid Damage Policy” of denying warranty coverage for an iPhone or iPod Touch whose white Liquid Contact Indicator (LCI) tape embedded near the devices’ headphone jack and/or dock connector was pink or red when presented for repair or replacement. Plaintiffs contend the company that makes the LCI tape admitted that humidity, not water contact, could cause the color to turn pink, if not red.

Class Members will include anyone who tried to repair or replace their iPhone on or before December 31, 2009, or tried to repair or replace their iPod Touch device on or before June 30, 2010, and were denied based on Apple’s former Liquid Damage Policy.

The proposed Settlement Agreement shows that some Class Members may be eligible to receive between $215 and $300 if they owned an iPhone, and between $105 and $265 if they received an iPod Touch. This amount may be doubled or less, depending on the number of claims filed.

The Apple iPhone/iPod Touch Warranty Class Action Settlement agreement is expected to be filed in San Francisco federal court within the next few weeks.

    My I-pod had close to 600 songs that took me forever to find. My dell computer got a virus. However, my I-pod held up. Freeze, Blackout, and now….DEAD! You guys make great products and the consumer trust you. When that trust is broken with your favorite toy….you feel robbed. Can I buy all those songs again just to lose them again,again and again. Did my I-pod died with Steve Jobs or was it made in vain.

    That just happen to me last year. iPod was still under warranty and they said it got water in it cause the tape was pink. That iPod never came close to water.

    my ipod touch they said they didn’t knw why it freezes when turning on cause the disc or something like that got scratched. there was no fix, they said.

    Had to take the Iphone 4 to the store several times as it would freeze, get hot and was really slow.

    my ipod constantly shut down and it gets hot, freezes alot, drops calls as well.
