Apple customers who say the performance of their iPhones was throttled after an iOS update could soon be getting a payout.
On Aug. 11, the 9th Circuit Court of Appeals dismissed an appeal challenging an agreement with Apple Inc. to settle the nationwide class action based on allegations that Apple issued software updates that slowed down the performance of iPhones, clearing the way for cash payments to consumers.
In 2020, Apple agreed to a $500 million settlement to resolve claims that the performance of Apple iPhones was diminished for people who owned older models.
The dismissal of the appeal to the settlement’s terms has paved the way for payments to begin being doled out to eligible claimants, of which there are estimated to be more than three million, CBS reports.
The settlement is the largest all-cash recovery in a computer intrusion case in history, and benefits a class of approximately 100 million iPhone users, plaintiffs’ counsel Cotchett, Pitre & McCarthy LLP (CPM) said in a news release.
“We are extremely proud that this deal has been approved, and following the Ninth Circuit’s order, we can finally provide immediate cash payments to impacted Apple customers,” CPM partner Mark C. Molumphy said.
Decision clears way for up to $90 cash payments
The class action was first filed in 2018. In 2019, the court ruled on Apple’s motion to dismiss and allowed several claims in the litigation to move forward, including violation of the federal Computer Fraud and Abuse Act, California’s Computer Data Access and Fraud Act, California’s Unfair Competition Law and Trespass to Chattels.
Under the terms of the Apple iPhone performance class action lawsuit, the company will pay between $310 million and $500 million, depending on the number of valid claims submitted.
The settlement will provide cash payments to class members of up to $90 per eligible device, CBS reports.
Only affected consumers who filed claims before the Oct. 6, 2020, deadline are potentially eligible to receive a Apple battery settlement check.
