A Lipitor lawsuit was filed by a 76-year-old woman alleging she developed type-2 diabetes after taking the statin drug Lipitor.
This lawsuit joins hundreds of similar Lipitor personal injury lawsuits centralized in the larger Lipitor multidistrict litigation (MDL) In re: Lipitor (Atorvastatin Calcium) Marketing, Sales Practices and Products Liability Litigation.
On Nov. 19, North Carolina resident Carrol S. and her husband filed this Lipitor type-2 diabetes lawsuit in South Carolina federal court claiming she suffered personal injury from her use of Lipitor, a drug commonly prescribed to help patients regulate their blood cholesterol level.
The woman allegedly began taking Lipitor sometime in October 2000 and continued to take the Pfizer drug until February 2004, at which time she ceased taking the drug.
However, in January 2003 the plaintiff was diagnosed with type-2 diabetes by her physician, according to the Lipitor type-2 diabetes lawsuit. The lawsuit alleges negligence, negligent misrepresentation, negligent design, breach of express warranty, breach of implied warranty, fraud and misrepresentation, constructive fraud, loss of consortium, unjust enrichment, and punitive damages.
The Lipitor Type-2 Diabetes Lawsuit is Case No. 2:14-cv-04467-RMG, in the U.S. District Court for the District of South Carolina.
Type-2 Diabetes and Lipitor Users
More than 4,000 women have reported developing type-2 diabetes after taking Lipitor to regulate their cholesterol. As a result of a large complaints of adverse reactions to Lipitor, the U.S. Food and Drug Administration (FDA) published a public health notice in August 2011, requiring Pfizer Inc. to include new information in its marketing, advertising, and labeling of Lipitor to reflect the growing number of Lipitor type-2 diabetes cases.
Supporting medical reports have suggested that the group of Lipitor consumers most at risk of developing type-2 diabetes are women.
In February 2012, Lipitor complied with the FDA order and updated Lipitor’s drug and product labels to include a type-2 diabetes risk warning.
Lipitor Side Effects
Many women have reported experiencing a number of other side effects after using Lipitor, including:
- Muscle problems, pain, or weakness
- Fever and tiredness
- Liver problems
- Nausea
- Diarrhea
- Upset stomach
- Joint pain
- Rhabdomyolysis
- Myopathy
