A group of Amazon customers from California and Texas allege in their class action lawsuit that they were duped into paying for a prime membership when they purchased products online from Amazon.

According to the Amazon website, “Prime members … enjoy exclusive access to movies and TV shows, ad-free music, Kindle books, original audio series and unlimited photo storage,” in addition to free shipping.

The plaintiffs allege that they purchased products from Amazon under the belief that they would not be charged for a “prime” membership; however, they say that unbeknownst to them they were actually charged for the membership for multiple years. The plaintiffs further claim that Amazon refused to provide a refund when they discovered their accounts were being charged for the prime membership without their consent or knowledge.

“[Amazon] represents to its consumers that they could use its services to purchase products directly from its website at no cost to the consumer in addition to the cost of the product,” the Amazon class action lawsuit states. “However, despite these representations, Defendant charged Plaintiffs and similarly situated consumers additional fees. Specifically, when consumers purchased products from Defendant, they were also charged an additional ‘Amazon Prime’ membership fee”

According to the class action complaint, the plaintiffs and proposed Class Members were never presented with written terms prior to their purchase of Amazon’s prime membership. Additionally, they say that Amazon represented to them and others that they would not be charged for a membership.

The plaintiffs seek to represent a nationwide Class of consumers who used Amazon and were charged for a prime membership along with Texas and California subclasses. The plaintiffs also seek to represent a subclass of individuals who had bank accounts that were charged the prime membership fee by Amazon using electronic fund transfers.

“[A]ll claims in this matter arise from the identical, false, affirmative written statements that consumers would not need to pay additional fees to purchase products from Defendant’s website,” alleges the class action complaint.

The plaintiffs allege that Amazon extracted between $100 and $400 electronically from their bank accounts for prime memberships they didn’t want.

“[Amazon] knew that their representations and omissions were untrue and misleading, and deliberately made the aforementioned representations and omissions in order to deceive reasonable consumers,” alleges the Amazon class action complaint.

According to the lawsuit, Amazon’s marketing and charging of the prime membership fees violates California and Texas consumer protection laws, as well as the federal Electronic Funds Transfer Act. The plaintiffs are seeking damages for these claims as well as an order requiring Amazon to notify its customers of its alleged false marketing scheme.

The Amazon consumers are represented by Todd M. Friedman, Adrian R. Bacon, Meghan E. George, and Thomas E. Wheeler of the Law Offices of Todd M. Friedman PC.

    Amazon got me for over $400 after my son and I combined our Prime accounts under their “family plan.” We alternated paying the entire annual $120 fee in November each year. A couple of years later I noticed the exact same debit coming out of my bank account going to Amazon. Got that corrected and got $175 back. A couple of years later I found out they started almost immediately taking it out of my Amazon credit card after I got the $175 back! They still have over $200 that they owe me and I have no way of recovering it. I haven’t bought anything from Amazon in almost two years and I never will again.

    I need to know how to file against Amazon over my Amazon Prime account. They have hit my debit card several times for my membership fee and when I contacted customer service they swear that each “attempt” was declined although I show on my statement the transaction was completed. I have once again had to cancel my card to keep them from accessing my account.

    The last time it was a purchase I made and Amazon and the seller were taking the amount out of my account…putting the amount back in and then withdrawing it again. Finally contacted Jeff Bezos..who finally corrected it.
    Now this next problem has come up and I have tried contacting him and he has NOT contacted me back.

      This has been happening to me for the 2 and a half years. I explained numerous times that a charge of 14.06 has been coming out of my account, they refund me and two years later I’ve become irate.with the situation. What’s even more sickening is I’ve changed my debit card twice since I initially had prime and canceled it in December 2019. When I asked them about the charges, they tell me it’s another name on the account. How? I’m a truckdriver gone 6 months out the year. They won’t tell me the name so I can sue, they just continue to denounce that and refund me or not. This is highly frustrating and conglomerates funnel capitalism at others expense

    I am also a customer of Amazon and to save money I always check “free shipping for orders over $25 or $35”. I HAVE NEVER JOINED AMAZON PRIME as I I think it is a waste of money. AMAZON signed me up for this service without my knowledge or consent. I didn’t know I had been charged this for 2 years until reviewing old bank statements. I NEVER ONCE used Amazon Prime or any of it’s supposed services. I would like to join a lawsuit to get my membership returned. I also repeatedly DID NOT CHECK THE OFFER FOR AMAZON PRIME, but the site signed me up anyway. I am retired on SSDI and can’t afford to waste even this amount of money on a service I never used.

    I have had this issue with Amazon for about two years. I have canceled cards. A couple of months it’s back on my account. I would definitely like to join this lawsuit. It’s been such a headache

    I have been charged since December 2019. For a service that I did not ask for. They have been charging me twice a month for Prime Membership and prime Video. $14.14 and $7.99 for prime Video two separate bills. I am just now finding this out today July 6, 2021. Please contact me. I want to be apart of this lawsuit.

    Finally googled Amazon class action lawsuit, as I have been through multiple Prime issues and couldn’t have been alone. I do not want, nor do I ever know how I wind up with, a Prime membership. It further pisses me off when I feel like functionally communicating with aliens would be a much easier task than canceling an unwilling membership and actually getting my full refund. And even FURTHER pisses me off when I’m offered/given credit for Amazon which is not always applied. Am I too late to join or should I start another lawsuit? Any info here would be great!
