Huggies Natural DiapersKimberly-Clark Corp., the maker of Huggies brand name diapers and wipes, has been hit with a proposed natural label class action lawsuit in New York federal court. This Huggies class action lawsuit filed by two consumers alleges Kimberly-Clark purposefully used misleading statements about their supposedly “natural” diapers and wipes, which according to the plaintiffs actually contain harmful, unnatural ingredients.

Plaintiffs Christina Franjul and Veronica Brenner filed this Huggies natural label class action lawsuit alleging they bought Huggies “Pure and Natural” diapers and Huggies “Natural Care” wipes products under the belief that these Kimberly-Clark products were safer and more environmentally friendly than traditional diapers and wipes. Both plaintiffs claim they relied on the Huggies product packaging that feature statements like “pure and natural” and “natural care” when deciding to buy these Kimberly-Clark manufactured diapers and wipes.

“Unfortunately for consumers, these representations are not true,” the Huggies natural label class action lawsuit alleges. “The diapers are neither pure nor natural because they contain unnatural and potentially harmful ingredients such as polypropylene and sodium polyacrylate. Likewise, the wipes are not natural because they contain unnatural and potentially harmful ingredients such as sodium methylparaben and methylisothiazolinone.”

The plaintiff claim that had they known these Huggies natural labels were false and misleading, they would not have purchased the diaper and baby wipe products.

The Huggies class action lawsuit states that Huggies natural diapers differ from other Kimberly-Clark brand diaper products in that the former use soft organic cotton; however, Franjul and Brenner point out that this organic cotton is only present on the outside of the Huggies natural diapers, the part of the hygiene product that never comes in contact with the baby.

Furthermore, “despite Kimberly-Clark’s marketing of it as entirely pure and natural, only differs from traditional diapers by including a liner that includes some materials that are potentially less harmful to the environment than materials used in traditional diapers,” the plaintiffs allege in the class action lawsuit.

Based on these claims, Franjul and Brenner allege that Kimberly-Clark’s representation of their Huggies natural diaper products through their packaging claims are false and deceptive to consumers.

This Huggies natural label class action lawsuit also takes issue with Huggies wipes, which allegedly contain sodium methylparaben, a compound banned in the European Union because of its ability to strip pigment from a person’s skin, as well as methylisothiazolinone, a chemical linked to allergic skin reaction and skin toxicity. Franjul and Brenner claim in their Huggies class action lawsuit that neither of the above named chemicals are considered natural and furthermore that the manufacturer failed to disclose these ingredients on the front label packaging for their Huggies wipes.

This Huggies natural label class action lawsuit brings several allegations against Kimberly-Clark, including claims of violation of the Magnusson-Moss Warranty Act, breach of express warranty, unjust enrichment, and violations of several state laws. The plaintiffs jointly seek to certify and represent a nationwide Class of consumers who purchased Huggies “Pure and Natural” diapers and Huggies “Natural Care” wipes. The complaint also indicates several proposed state subclasses in this natural label class action lawsuit.

The plaintiffs are represented by Scott A. Bursor, Joseph I. Marchese, Neal J. Deckant and Yitzchak Kopel of Bursor & Fisher PA.
