USALCO, Southern Ionics, and American Securities have agreed to pay a total of $25.6 million to resolve claims that they fixed the price of liquid aluminum sulfate.

The settlement will benefit direct purchasers of liquid aluminum sulfate between Jan. 1, 1997 and Feb. 28, 2011. Indirect purchasers are not included in this settlement. A full list of defendants can be found in the “Who’s Eligible” section below.

The antitrust class action lawsuit was filed by several cities and water companies across numerous states. According to the plaintiffs, several defendants conspired together for years to artificially fix the price of liquid aluminum sulfate.

Liquid aluminum sulfate, sometimes referred to as “Alum,” is a chemical used for treating drinking water, controlling algae in bodies of water, treating wastewater, and for certain manufacturing purposes.

USALCO, Southern Ionics, and American Securities have all agreed to pay into a settlement fund to resolve the claims against them, although they do not admit any wrongdoing. USALCO has agreed to pay $6.1 million, Southern Ionics has agreed to pay $6.5 million, and American Securities has agreed to pay $13 million.

Payment amounts from the settlement will vary depending on a number of factors including the total number of claims, the amount of claimed purchases, and the net settlement fund after costs and fees. Each Class Member will receive an equal share of the settlement fund based on the dollar value of their purchases.

In order to benefit from the settlement, Class Members need to file a valid claim by Nov. 7, 2019. Class Members may need to provide purchase orders, invoices, and other documentation to validate their claim.

The deadline for exclusion was July 26, 2019. The deadline for objection passed on April 2, 2019. The final approval hearing for the settlement is scheduled for Sept. 26, 2019.

Who’s Eligible

Consumers who purchased liquid aluminum sulfate directly from one of the defendants between Jan. 1, 1997 and Feb. 28, 2011. Indirect purchasers are not included in this settlement.

Defendants include: General Chemical Corporation, General Chemical Performance Products LLC, General Chemical LLC, GenTek Inc., Chemtrade Logistics Income Fund, Chemtrade Logistics Inc., Chemtrade Chemicals Corporation, Chemtrade Chemicals US LLC, Chemtrade Solutions LLC, C&S Chemicals Inc., Kemira and Chemtrade, USALCO LLC, Kemira Chemicals Inc., Southern Ionics Inc., American Securities LLC, and various executive officers.

Potential Award

Varies. Each Class Member will receive an equal share of the settlement fund based on the dollar value of their purchases. Payment amounts from the settlement will vary depending on a number of factors including the total number of claims, the amount of claimed purchases, and the net settlement fund after costs and fees. No estimated payment values are available at this time.

      A very odd update:
      A letter just posted TODAY by class counsel on PACER regarding the status of claims and it stated that payments were mailed to claimants on March 20, 2020 and that a second distribution will not be economical after addtl atty fees are paid. I know I submitted a claim and never recieved a payment so i called in to claims administrator and she says she was not aware that any distribution has been made yet but to email the administration at the email on the claims website for more information. No response yet.
