A new semi-truck accident lawsuit has been filed in the U.S. District Court for the Northern District of Ohio, Western Division as of Nov. 14, 2018. The complainant is plaintiff Nicole H., a citizen and resident of the state of Ohio, who alleges she suffered primary injuries to the head, face, and neck secondary to being thrown into the windshield of the vehicle in which she was a passenger.
She also has filed this semi-truck accident lawsuit on behalf of her underage son C.J., who she alleges suffered loss of consortium because of her injuries. Nicole has named Republic Express Corp., who is the registered owner of the truck in which the driver of her vehicle was forced to collide with at the time of the accident.
She also named as a defendant in her semi-truck accident lawsuit Benito G., the driver entrusted to drive the massive truck which allegedly caused the unfortunate incident.
According to Nicole’s narrative in the semi-truck accident lawsuit, the collision between the defendant’s semi-truck and the 1998 Honda Civic in which she was a passenger occurred on Nov. 28, 2016. The accident purportedly happened at the intersection of County Road D and SR 108 in Fulton County, Ohio.
The Republic Express truck was allegedly traveling westbound on County Road D, and Nicole’s driver—Jeremy V.—was traveling northbound on SR 108.
The semi-truck accident lawsuit claims that the truck failed to yield right of way to Jeremy who had no traffic control lights or stop sign to indicate that he should slow down, stop, or cease to proceed on the intended route. At the same time, truck driver Benito G. was provided with traffic control stop sign but allegedly moved into the intersection without compliance.
Nicole says Jeremy was unable to stop his Honda Civic from running into the side of the truck at the specified speed of SR 108 traffic and the limited to no warning. Nicole’s seat belt allegedly failed under the circumstances, and her head struck the windshield forcibly causing a skull fracture and multiple lacerations from the impaled glass. The rest of her body hit the dashboard, she claims, and there was an injury to her left leg as well from the impact.
The semi-truck accident lawsuit indicates that Nicole was taken by an emergency management vehicle to the closest hospital for treatment. At the hospital, she says her lacerations were painfully taken care of and she was subjected to surgery in order to remove shards of glass from her eyes. To date, the plaintiff says she is disfigured by permanent scarring near her right eye.
Benito G. was charged with failure to comply with traffic control signs by Ohio State Patrol. Nicole argues this action on the part of law enforcement points blame toward this defendant and the owner of the truck by extension, according to her claim.
Nicole brings several causes of action against the defendants which include but aren’t limited to Negligent Entrustment, Negligence Per Se, Negligence, and Vicarious Liability.
She also claims Loss of Consortium on behalf of her minor son C.J. Both while she was undergoing treatment and as a result of her ongoing injuries, she says his life has been affected by the decrease in her ability to be present, provide affection, and attend to normal childhood activities.
