A Sephora employee lawsuit has been brought before a San Francisco judge, the plaintiffs asking that the judge grant class certification for the wage-and-hour lawsuit.

According to the Sephora employee lawsuit, employees were not properly compensated for all of the time worked. A team of attorneys is involved in the Sephora employee lawsuit, representing around 8,000 individual Sephora workers.

According to the Sephora employee lawsuit, workers were required to spend time going through security, putting on makeup before shifts, and other tasks, but were not compensated for this time.

While Judge Karnow worried that the lack of information surrounding this uncompensated time could raise liability issues, one of the attorneys working on the Sephora employee lawsuit noted that this is the fault of Sephora, which “had a duty to track.”

“As far as liability goes, a lot of the claims involve time,” the attorney argued. “You can’t allow an employer to avoid paying employees by virtue of the fact it didn’t track its time. That means an employee cannot prove his or her damages. If they had tracked time, we wouldn’t be having this conversation.”

The Sephora employee lawsuit notes that Sephora has started compensating for an extra three minutes in order to cover time spent in security for bag checks, indicating that the company itself recognizes it had been failing to compensate for this time previously.

The Sephora employee lawsuit also includes claims that the cosmetics retailer failed to provide them with proper meal and rest breaks, according to state law, as well as compensate for overtime, violating California labor laws.

Wage and Hour Regulations

There are a series of both federal and state wage and hour laws put in place to protect workers and ensure they are treated fairly. However, many workers across the country do not know the protections that the Fair Labor Standards Act (FLSA) offers, which can lead to employers taking advantage of them, in some cases requiring unpaid overtime work despite the illegality of doing so.
