A robocalls lawsuit against Sunrun Solar has ended with a settlement of $5.5 million. The class action robocalls lawsuit alleged that the company was purposefully reaching out to phone numbers on the Do Not Call Registry.

Although Sunrun Solar continued to argue throughout the robocalls lawsuit that their practices were compliant with the Telephone Consumer Protection Act (TCPA) and claimed at the end that they wanted to avoid further litigation, consumers say persistent and unsolicited calls came from the company.

The robocalls class action lawsuit accused the company of making automatic and prerecorded calls to promote solar energy products made by Sunrun Solar and its subsidiary, Clean Energy Experts LLC. The settlement in the robocalls lawsuit will cover settlement administration costs, as well as the process of creating a toll-free number for Class Member questions and concerns.

Class Members include those who received pre-recorded, automatic, and unsolicited voice calls and individuals who received more than one phone call from the companies while the consumer’s phone number was placed on the Do Not Call registry.

Although Sunrun Solar contends that the class action lawsuit is not appropriate for class certification, that process will happen if the robocalls lawsuit settlement is approved by the court.

The Do Not Call Registry was added to the TCPA after consumers complained of companies contacting them with unsolicited marketing information over the phone. When a person receives these unsolicited calls the first time, they can add their number to the Do Not Call Registry and request that the company discontinues contact.

While it takes some time for a person’s entry onto the Do Not Call Registry to go into effect, continued marketing efforts by companies can violate consumer protection laws under the TCPA. Companies can be held accountable for this behavior if a consumer or group of consumers file a lawsuit.

Many consumers in the robocalls class action lawsuit expressed frustration, not just with the unsolicited marketing materials, but also with the use of automatic messages and pre-recorded audio that played when the they answered the phone.

The TCPA prohibits specific types of actions, including how companies can communicate with consumers over the phone. When this law is violated, companies can face steep fine of up to $1,500 per violation.

The settlement agreement in the Sunrun Solar robocalls class action lawsuit included a statement from the head company that they would monitor all telemarketing activities for the following four years to verify company compliance with the TCPA.

Another aspect of the robocalls lawsuit settlement is that CEE and Sunrun will have to merge their do not call lists and discontinue robocall practices that violate consumer protection laws.
