A new data breach class action lawsuit accuses a software company who supports Best Buy, Delta and Sears customers with voice and chat services of failing to safeguard consumer data that was exposed in 2017.

The class action lawsuit filed against [24]7.ai Inc. claims that the company collects personal customer data while chatting with them on the websites for these companies.

Lead plaintiff Madison Copeland also says the live chat company failed to notify affected consumers in a timely fashion that the customer data obtained from these chat sessions had been compromised or stolen.

The data breach class action lawsuit says that the software company should have had security protocols in place that would have prevented the Best Buy, Sears, and Delta data breach to begin with.

Delta and Sears came forward with information about the data breach on April 4, 2018, and Best Buy released information about the breach one day later.

All of these instances involved an unauthorized third party who accessed the customer service chat services maintained by [24]7.ai.

Unfortunately, as the proposed class action lawsuit alleges, many different retailers and businesses have been involved in data breaches in recent years.

Numerous consumers have had their personal details leaked in these breaches and been informed after the fact. This has drawn media and consumer attention to security protocols that businesses do or do not have in place to prevent breaches.

The [24]7.ai class action lawsuit says that the company waited more than six months after their own discovery of the breach before notifying consumers about the problem.

Copeland alleges on behalf of herself and other Class Members that the personal information provided during a chat session could now be accessed by criminals and may increase the risk of identity theft.

The plaintiff in this data breach class action lawsuit says she made five purchases on the Best Buy website between Sept. 19, 2017 and Oct. 17, 2017.

On April 25, 2018, she reportedly received a letter from Best Buy entitled “Notice of Data Breach.”

The class action lawsuit seeks compensation for theft of financial information, unauthorized charges on credit or debit accounts, loss of privacy, loss of use, and loss of productivity. The data breach lawsuit also claims that the defendant did not offer credit monitoring to the affected consumers.

The data breach class action lawsuit seeks to represent a Class of nationwide consumers who use the electronic customer service platform of or who shopped on the websites of Delta, Best Buy, or Sears and had their data compromised as a result.

The plaintiff is represented by Daniel L. Warshaw, Melissa S. Weiner, and Joseph C. Bourne of Pearson Simon & Warshaw LLP.

    I was hacked by Sears/Kmart data breach since 2015 several times. I had to close my account to my email and Sears blocked my Sears/Kmart account because they said I had numerous accounts through Sears.com & Kmart.com when I didn’t. I even won a prize from them I couldn’t claim it because I couldn’t even open my email cause it was hacked. Please add me!!!
