Man Files TCPA Lawsuit After Allegedly Receiving More Than 400 ADT RobocallsA man has filed a lawsuit alleging he received more than 400 ADT robocalls after he told a representative to stop calling his cell phone.

Plaintiff Richard J. says he first began receiving ADT robocalls in May 2018. The calls were made in an attempt to collect a debt he allegedly owed.

Richard claims when he would answer the ADT robocalls, an automated system would instruct him to hold for an operator. Such a greeting is indicative that an automatic phone dialing system and artificial or prerecorded voice are being used by the caller.

During at least one call in May 2018, Richard says he waited on the line and spoke with a representative. He allegedly told the ADT representative that he wanted ADT to stop calling his cell phone.

The ADT robocalls continued. Richard says he received as many as 420 ADT robocalls from May through August of 2018.

As a result, Richard alleges he has suffered injuries and harm that include the following:

  • Invasion of privacy
  • Intrusion upon and interference with the capacity of his cell phone
  • Wasting his time
  • Risk of personal injury because of interruptions and distractions upon receiving ADT robocalls
  • Depletion of his cell phone’s battery
  • Cost of electricity to recharge his cell phone’s battery
  • Stress, aggravation, emotional distress, mental anguish and other similar damages

ADT Robocalls Allegations

Richard alleges the ADT robocalls violated the Telephone Consumer Protection Act (TCPA) because he did not give his express consent to contact him using an automatic phone dialing system or an artificial or prerecorded voice mechanism.

He further alleges that ADT committed knowing and/or willful TCPA violations, which would allow him to be awarded $1,500 for each and every violation.

This is not the first lawsuit to hit the company over ADT robocalls. Last year, a Georgia man claimed that he received calls from ADT in violation of the TCPA.

U.S. Congress passed the TCPA in 1991 because of the increasingly large number of consumers who complained about receiving constant telemarketing or debt collection phone calls. The TCPA was designed to protect consumers’ privacy and to reduce the number of calls consumers receive that they would consider nuisance calls.

According to the TCPA, any person or business who initiates a call to a cell phone using an automated phone dialing system or artificial or prerecorded voice without prior consent from the recipient can be held liable for actual monetary loss or up to $500 in damages for each violation of the TCPA — whichever is greater.

If the person or business has willfully and knowingly violated the TCPA, the court has the option of increasing the damage award up to $1,500 per violation.

According to the ADT robocall lawsuit, Richard is demanding a trial by jury.

ADT offers security and automation systems for homes and businesses in North America. The company announced its initial public offering of stock in January 2018, and employs approximately 18,000 people. ADT has settled a robocall lawsuit in the past, paying $15 million to exit a class action lawsuit in 2013.

The ADT Robocalls Lawsuit is Case No. 1:18-cv-06236 in the U.S. District Court for the Northern District of Illinois, Eastern Division.

        I HAVE BEEN HARRASSED BY ADT SECURITY SO BADLY UNTIL I FINALLY GAVE IN AND ALLOWED THEM TO SET UP A CAFE I WAS THE MANANGER FOR AND WHEN THE CAFE HAD TO CLOSE DUE TO THE COVIC & THE LEASED BUILDING PLUMBING AND LOACK OF VENTILATION SYSYTEM NOT WORKING. ADT REFUSED TO TAKE THEIR EQUIPMENT BACK AND STARTED CALLING ME AND PUT THE ACCOUNT IN COLLECTIONS WHICH THE COLLECTIONS DEPT STARTED HARRASSING ME DAILY
