In a recent asbestos lung cancer lawsuit filed in a California court, a couple filed a lawsuit against 3M Company and other named defendants alleging that because of exposure to asbestos-containing products, they suffered multiple injuries.
Plaintiffs Carroll and Lorna H. filed the asbestos lung cancer lawsuit on Sept. 18, 2018.
According to the asbestos lung cancer lawsuit, Carroll says that his former employers “breached their duties” by failing to warn him of the dangers associated with exposure to asbestos and asbestos-containing products.
He says that “they knew or should have known that exposure to their asbestos-containing products would cause disease and injury.” The couple accuses the employers of “failure to exercise reasonable care” to warn Carroll of appropriate and safe precautionary measures that could have been used when he would be working with asbestos-containing products.
The defendants also allegedly failed to remove the products once they knew that they provided dangers to him and other employees.
The couple argues it was the defendant’s job and duty to discover the hazards that these products provide and to remove them to eliminate the dangers and severe adverse side effects that are associated with exposure to asbestos-containing products.
The defendants allegedly failed “to advise plaintiff and others that the risks inherent in their asbestos-containing product greatly outweighed the benefits, if any, afforded by such products…,” the asbestos lung cancer lawsuit states.
Carroll says that as a result of asbestos exposure, he suffers and continues to suffer permanent injuries and future risks of injuries. He says that he suffers bodily and health injuries including lung cancer, asbestos pleural disease, asbestosis and emotional and mental distress.
The asbestos lung cancer lawsuit was filed on multiple counts including strict liability, false representation, premises owner and contractor liability, negligence, and loss of consortium.
