Top Class Actions viewers are reportedly receiving checks for up to $127.24 from a Uber class action settlement over allegations that they received unwanted text messages from the rideshare giant.

The Uber text message spam class action lawsuit alleged that the plaintiffs, California and Illinois residents, along with thousands of other consumers were sent spam text messages.

The plaintiffs claimed that even though they asked Uber to stop sending the messages, it continued in violation of the Telephone Consumer Protection Act (TCPA).

 

The Uber text message spam class action lawsuit also claimed that the rideshare company failed to verify that the individuals whose mobile phone numbers they used to send advertising messages actually wanted to receive the texts.

The unwanted text messages were allegedly sent starting Dec. 31, 2010 until Aug. 17, 2017.

The Uber text message spam class action settlement included three settlement Classes; Settlement Class, Settlement Class B, and Settlement Class C. The Settlement Class covered those who received messages in connection with Uber’s Refer-a-Friend Program. Class B covered individuals who began Uber’s driver application process but did not become a driver. Settlement Class C included individuals who had not provided a number to Uber, but still received marketing text messages.

Under the TCPA, companies like Uber are prohibited from sending unwanted text messages without prior consent. Companies that do so may find themselves subject to steep fines of up $1,500 per violation, or unwanted message, call, or other communication.

Though the company contended that the plaintiffs in the Uber text message spam class action lawsuit had agreed to receive the messages, the parties ultimately agreed to settle in 2017.

According to the Top Class Actions Facebook page, Class Members who filed valid claims for the Uber text message spam class action settlement began receiving checks for as much as $127.24 just recently.

If you filed a valid claim for this settlement, keep your eye on your mailbox because checks are arriving.

Under the terms of the Uber text message spam class action settlement, a $20 million settlement fund was established. These funds will be distributed to Class Members pro rata based on the number of claims. No proof of purchase was required for Class Members to make a valid claim.

The deadline to file a claim passed on Dec. 15, 2017.
