A Kansas resident and citizen recently files a Trinity guardrail lawsuit, alleging that due to failure of a highway guardrail manufactured by the company he sustained serious injuries.
Plaintiff James H. is filing the Trinity guardrail lawsuitdemanding a trial by jury. The lawsuit was filed on June 21, 2018.
According to the Trinity guardrail lawsuit, Trinity is alleged to have sold and manufactured an ET-Plus End Terminal, part of a highway guardrail that provides protection and a safe barrier for drivers on the road.
However, due to the allegedly defective nature of the guardrail, it instead left James suffering severe and serious injuries, the lawsuit states.
On March 7, 2017, James says that he was involved in a motor vehicle collision on Highway 71 in Jackson County, Mo. His vehicle hit the ET-Plus End terminal and led to him sustaining severe injuries, including leg amputation.
James says that he has, due to these injuries, “incurred medical expenses and will incur them in the future, has endured and will continue to endure pain and suffering and loss of enjoyment of life, past and future loss of income and earning capacity …” He has also otherwise “suffered personal and pecuniary damages,” the guardrail lawsuit states.
The Trinity guardrail lawsuit was filed on multiple counts of strict liability and negligence. James demands a trial by jury.
Overview: Trinity Guardrail Lawsuit
Many people and their loved ones are reporting serious injuries upon impact by highway guardrails manufactured by Trinity Industries. While the end terminals of highway guardrails are supposed to be manufactured so that they peel off in the cases of a motor vehicle collision, Trinity’s manufactured version is said to be defective and ill-designed.
Highway guardrails work by being composed of two parts: the guardrail face and guardrail end terminal. The guardrail face is the length of the guardrail which attaches to posts implanted into the ground. The guardrail end terminal includes a guardrail face that is typically covered in yellow and black stripes.
The highway guardrails are being said to have been allegedly ill-designed by Trinity. In fact, the modified versions were allegedly redesigned without notifying the Federal Highway Administration (FHA).
According to reports, the end systems of Trinity guardrails may impale vehicles instead of peeling away. Guardrail lawsuits being filed against Trinity allege that the dimensions of the rail heads have been changed without notifying federal regulators such as the FHA.
The modified version was said to save Trinity roughly $2 per head, but allegations state that in cases of motor vehicle accidents the rail heads can potentially slice through the car.
Additionally, a study conducted by Car and Driver reported that the new manufactured version allows motor vehicle accident collisions to be four times more fatal than its previous version.
Since its new design, there have been several Trinity guardrail lawsuits filed by motor vehicle accident victims and their families. Death, amputations and other serious injuries have been reported to occur due to the new design.
The Trinity Guardrail Lawsuit is Case No. 4:18-cv-00483-GAF, in the Circuit Court of Jackson County, Missouri at Kansas City.
