Deceased Man's Estate Sues over Denied Disability Insurance AppealAfter a heart attack and other disabling problems, eventually leading to his death, a man was allegedly denied his Unum insurance benefits and subsequent disability insurance appeal. After his death, the administrator of his estate filed a lawsuit against Unum.

The decedent, Lawrence M., worked as a financial advisor and, through his employer, had a life insurance and disability insurance plan from Unum in place.

His estate’s administrator says that in February 2016, Lawrence suffered from a heart attack. He underwent cardiac ablation surgery that August, allegedly leading to disability. He also suffered from bipolar disorder and chronic stress. The Unum lawsuit claims that factors made him disabled according to the Unum policy.

In October 2016, Lawrence allegedly applied for long term disability benefits, but Unum denied his application in January 2017. He filed a disability insurance appeal in July 2017, the administrator says. He provided additional information as well to support the disability insurance appeal. The appeal was denied in August 2017.

Lawrence allegedly filed another disability insurance appeal in February 2018. But in March 2018, Lawrence’s second disability insurance appeal, too, was denied.

After Lawrence’s death in April 2018, a family member became the administrator of his estate and—no longer with any administrative means of combatting the issue—filed a lawsuit over the allegedly wrongful denial of Lawrence’s disability insurance benefits.

The Unum disability insurance lawsuit was filed on Aug. 10, 2018, in the U.S. District Court for the Tampa Division of the Middle District of Florida.

Filing an Unum Disability Insurance Appeal Denial Lawsuit

A growing number of plaintiffs like Lawrence’s estae administrator are filing disability benefits lawsuits against Unum, claiming that the insurance giant unfairly denied their disability claims to benefits that they actually qualify for under the terms of their insurance policies, often provided by employers.

This Unum lawsuit and others like it allege that Unum, as the largest disability insurance company in the country, has unfairly denied the disability insurance claims of policyholders like Lawrence who are in fact qualified to receive such benefits. Some lawsuits even allege that the company purposely denied the claims of hundreds of thousands of workers with legitimate disabilities for no reason other to increase company profit. Former employees of Unum have reported that they were instructed to purposely deny insurance to people with legitimate claims to disability benefits in order to fulfill the company’s quota.

People who have exhausted all recourse through applications and appeals for disability benefits may turn to filing a lawsuit over denied disability benefits, hoping to reverse Unum’s denial.
