A woman has filed a hotel slip and fall claim against Hilton Worldwide Holdings Inc. over injuries she allegedly sustained at a Philadelphia hotel.
According to the hotel slip and fall claim, plaintiff Karen K. says that she stayed in one of the defendant’s hotel rooms in August 2016. One day, she says that as she was taking a shower in the bathroom, she suddenly slipped and fell.
Karen alleges the fall happened due to a defective bathroom shower that she claims was excessively slippery and was in a defective and dangerous condition. The slip and fall lawsuit states that the hotel failed to provide a safe and slip-resistant shower.
“The hazardous, dangerous, and defective condition of the bathroom tub and/or shower floor or walking and/or standing surface within Defendant’s premises existed prior to Plaintiff’s fall and was a proximate cause of her slip and fall and the injuries and damages that she has sustained as a result of same,” the personal injury lawsuit states.
Karen files the hotel slip and fall claim seeking compensation to help cover treatment for medical care and therapy.
The hotel slip and fall claim was filed on a count of general negligence, accusing the hotel of acting with careless, negligent, and reckless conduct; of failing to provide a bathroom tub and/or shower in a safe and proper manner; of negligently allowing a defective and dangerous condition; and of failing to maintain the premises, among others.
The hotel slip and fall claim demands a trial by jury and was filed on Aug. 15, 2018.
Overview: Hotel Slip and Fall Claim
Other persons who had an experience similar to Karen’s may be in a position to bring a hotel slip and fall claim of their own. Some questions to help determine whether a personal injury claim may be viable include:
- Whether you suffered from a personal injury and not just from property damage
- Whether your injuries were caused by another person or entities’ negligence
- Whether you have recoverable damages
Negligence is defined as“[t]he failure to do an act which a reasonable careful person would do, or the doing of an act which a reasonably careful person would not do, under the same or similar circumstances to protect oneself or others from bodily injury, death, property damage.”
A person may be legally responsible or “liable” for the injuries of another if the person or entity acted in a careless of “negligent” manner. Therefore, a court may ender you eligible to receive compensation through the filing of a personal injury claim and thus obtain compensation or an award that can help with incurred medical bills; physical and emotional pain or suffering; lost wages; loss of earning capacity; and loss of companionship and support.
The Hotel Slip and Fall Claim Lawsuit is Case No. 2:18-cv-03469-WB, in the Philadelphia Court of Common Pleas.
