The Route 91 Festival Shooting took hundreds by surpriseA class action investigation has been launched against MGM International Resorts and one of their locations, the Mandalay Bay Hotel Las Vegas, after the tragic Route 91 Festival shooting left many concert attendees seriously injured or killed.

The victims have reportedly suffered multiple damages as a result of the Route 91 Festival shooting. Injuries include bodily harm from the bullets and being trampled by the panicked crowd, but many more have cited emotional or mental injuries, including post traumatic stress disorder (PTSD).

The Route 91 Festival shooting occurred on Oct. 1, 2017, when a shooter’s rampage left 58 people dead and 546 injured. Numerous other victims have reported other injuries or emotional trauma, as well as incurring medical expenses while being unable to work.

Compensation for Victims

Thousands of victims of the Route 91 Festival shooting have applied for financial assistance from various state run programs, which have funding reserved for people who suffered damages from violent crimes. One of these compensation programs is the Las Vegas Victims Fund, which was established soon after the Route 91 Festival shooting occurred.

Reportedly, close to $22 million was raised in the weeks following the Route 91 Festival shooting, which program administrators were supposed to distribute to victims who suffered physical injuries or emotional damages. However these victim compensation funds can only accommodate so many victims, reportedly causing many to be denied financial assistance.

Overview of Route 91 Festival Shooting Litigation

Many Route 91 Festival shooting victims have reported being denied financial assistance from the program, for “not being injured enough” or other ambiguous reasons.

This has spurred many of these victims to file legal action against MGM Resorts International and the Mandalay Bay Resort, along with the music festival’s host LiveNation. Furthermore, claimants are also seeking over $5 million from the estate of the shooter.

People filing legal action against MGM Resorts, the Mandalay Bay and Live Nation allege the companies failed to take the necessary precautions to insure the safety of the music festival attendants and the other hotel guests. In addition, each of the companies allegedly failed to respond to the subsequent panic that was caused by the Route 91 Festival shooting.

At this point in time, hundreds of Route 91 Festival shooting victims have filed legal action claiming MGM and LiveNation acted negligently; the largest of these claims consists of 450 plaintiffs.

Overall the allegations specified by Route 91 Festival shooting victims include, but are not limited to:

  • MGM allegedly not having sufficient security policies
  • MGM allegedly failed to properly train staff for emergency situations
  • MGM allegedly having insufficient surveillance of the Mandalay Bay Hotel
  • MGM allegedly failed to quickly respond after security guard Jesus Campos was shot
  • MGM allegedly gave the shooter access to a Mandalay Bay service elevator, which gave him the ability to sneak in weapons and ammunition to his hotel room that was later used in the Route 91 Festival shooting
  • LiveNation allegedly failed to provide enough exits for the event
  • LiveNation allegedly failed to train employees for cases “of a foreseeable event, such as a terrorist attack or other emergency”
  • LiveNation allegedly failed to utilize loudspeakers, video monitors, or media boards to broadcast evaluation instructions during the Route 91 Festival shooting
