Unum Life Insurance Company of America faces another woman’s Unum disability benefits lawsuit over allegations that the company unfairly denied her long-term disability benefits.
Plaintiff Alma R. files the Unum disability benefits lawsuit over unfair denial in California federal court, joining a growing number of lawsuits being filed against the company. The lawsuit was filed on June 1, 2018.
According to the Unum disability benefits lawsuit, Alma is the mother of three adult children. She says that she emigrated to the U.S. from Mexico and worked as a housekeeper or seamstress before obtaining a position as a Team Leader at Owens-Corning.
In 1997, she says sheobtained a position as a Mold Specialist that required her to perform various functions such as carrying and kneeling. However, she alleges she eventually suffered bilateral knee damage and low back degenerative disk disease. Over time, her condition worsened, she says. She applied for long-term disability though Unum on March 1, 2004.
Unum paid her benefits for 12 years. However, citing that her physical condition doesn’t refrain her from performing light work, Unum denied her long-term disability benefits in a letter on Feb. 20, 2017. Alma says she attempted to appeal the denial on May 10, the lawsuit states, maintaining that she “disagreed with the decision to terminate benefits because both her knees are weak and prevent her from moving frequently without pain in her low back and right hip.”
However, she says Unum reaffirmed their request to deny benefits in a letter sent back to her on June 28, 2017. The Unum disability benefits lawsuit was filed on a count of breach of contract, and for an award of attorneys fees and costs.
