Costco urged a federal court to toss a class action over frozen berries that were allegedly contaminated with hepatitis A because none of the plaintiffs claim that they had actually become ill after consuming the product.

Lead plaintiffs hit the retailer, as well as producers, in 2013 with the Costco hepatitis A frozen berry recall class action lawsuit after Townsend Farms Organic Antioxidant Blend berries were recalled due to concerns about contaminated pomegranates included in the mix.

Costco points out in its most recent motion to dismiss the case that none of the plaintiffs have alleged that they suffered any physical harm.

“Plaintiff’s strict products liability claims fail because there is no evidence that plaintiff consumed a defective product that was actually contaminated with the hepatitis A virus,” stated the company’s motion to dismiss the Costco hepatitis A frozen berry recall class action lawsuit.

An estimated 165 people did get hepatitis A after consuming the Townsend mix, but none of those who became ill are named as plaintiffs in the Costco class action lawsuit.

“Indeed, despite hundreds of thousands of units of the Product being recalled, the number of consumers actually diagnosed with the Hepatitis A virus was limited to about 165, none of whom are plaintiffs in this action,” stated the company’s motion to dismiss the Costco hepatitis A berry recall class action lawsuit. “Further, Plaintiff did not testify to having suffered any material physical harm. Plaintiff learned of the potential contamination from a new[s] story. Plaintiff then received an immune globulin shot.”

Not every bag of the berry mix was contaminated, argues the warehouse retailer in its motion to dismiss the Costco hepatitis A frozen berry recall class action lawsuit. In fact, claims Costco, the store went above and beyond to offer those affected by the recall vaccinations free of charge and without proof of purchase.

The Costco hepatitis A frozen berry recall class action lawsuit was initiated in 2013 after the recall of Townsend Farms Organic Antioxidant Blend frozen berries sold through the warehouse.

The plaintiffs allege that not all of them received the free vaccinations and they also had to undergo blood testing at their own expense.

Costco has made a number of unsuccessful attempts to dodge the contaminated berries class action. In another win for the plaintiffs, the Costco hepatitis A frozen berry recall class action lawsuit’s proposed Classes, including several subclasses, were certified in 2016.

The plaintiffs are represented by attorneys William D. Marler and Denis Stearns of Marler Clark LLP.

UPDATE: On Oct. 31, 2018, consumers were able to get Costco to agree to reimburse medical expenses for those affected by an alleged hepatitis A frozen berry recall, as a part of a class action settlement.

UPDATE 2: On Jan. 17, 2019, a federal judge presiding over a frozen berry Costco class action lawsuit has denied the defendant’s motion to dismiss non-California plaintiffs from the case.

    Costco is a slimy liar. My wife, son, and I all got hepatitis A from those berries from Turkey. Painful liver, extreme fatigue, diarrhea, mild fever, stinking urine, low appetite. My wife turned yellow. My son’s and my complexion were not normal. Took about a month or so for our energy levels to return to a normal range. Went to Costco about two weeks after infected after got a letter from Costco to throw out the berries and will get a refund. Went to tell them my family got sick and inquire about vaccine shots they said they would give. Clueless. Not helpful. Ended up going to Kaiser for the shots. Kaiser would like to sweep it under the rug and pretend only a few (165) got sick. My family members are surely not on their list of 165. And I’ll bet there are a thousand more out there who never got on that list possibly even one or two elders who died unnoticed. There was no genuine effort made to responsibly help those who were harmed. Costco would just like this to disappear. My liver still hurts chronicly and I don’t drink (never did beyond an occasional beer or two), so the only thing I can think of is the Hep A infection and wonder if our quality of life has been lowered because of this in particular or whether any of our lives could be shortened. In particular, my wife had had Hep B twenty years earlier in China from shell fish so she has suffered two unlucky hepatitus hits in her life and regularly complains her liver hurts. The suit should not be dismissed. Get some of the people who were affected on the list of that’s the issue. You can add my name for one, and I’m sure my wife and son would also want to be on such a list.

      I agree with you! I as well got sick from these berries immediately, turned jaundice and my shit turned white from my liver not working. My loved ones worried my skin was yellow. I was always at the doctors office for a solid month trying to get to the source of why & how I got sick. Oh yes, it was released public of the contaminated berries and made total sense to me because I consumed two bags that Costco was personally calling me on the phone to warn me not to eat anymore because I have the contaminated ups at my house. Thank goodness their computer membership records know exactly what you buy but now they are in denial that any of us that submitted claims really got Hep A. This is insane, especially after being sick for several months and ongoing tests like I was dying. Its very disturbing to be directly affected from this by getting Hep A and reading this report. Im going to boycott Costco!
