A settlement has been reached in a class action lawsuit alleging Monster Inc., Best Buy Stores LP, and BestBuy.com LLC falsely advertised Monster HDMI Cables by tricking consumers into thinking they needed a more expensive type of product.
If you bought a Monster HDMI Cable between Aug. 25, 2011 and March 6, 2018, you could get $10 to $35 in cash or store credit from the Best Buy class action settlement.
Lead plaintiffs alleged in their Monster, Best Buy class action lawsuit that consumers were deceived by the product packaging on Monster HDMI Cables and were duped into spending money on a more powerful HDMI cord than necessary for their high-def TVs.
The Monster HDMI Cables at issue in the class action lawsuit include the Advanced High Speed, Ultimate High Speed, and Ultra High Speed.
Monster and Best Buy agreed to settle the HDMI Cables class action lawsuit, although they admit no liability. Under the terms of the settlement, Class Members can receive either store credit or a cash payment. The amount of the settlement award depends on the type of HDMI cord purchased.
Best Buy, Monster customers who are able to submit a proof of purchase along with their Claim Form have no limit to the number of claims they can file for. Those consumers who are unable to provide a receipt will be limited to one claim for store credit.
The deadline to opt out of or object to the settlement is June 18, 2018.
Who’s Eligible
Class Members include consumers who bought a Monster HDMI Cable with an advertised bandwidth exceeding 10.2 Gbps in the U.S. between Aug. 25, 2011 and March 6, 2018.
Potential Award
$10 – $35 in cash or store credit.
Depending on the type of HDMI cord purchased and whether or not you can provide proof of purchase has an impact on what payment you can receive from this settlement. According to the settlement administrator, the benefit options include:
“Option A (Monetary Payment):
- $10 for each Monster Gold HDMI Cable purchased;
- $10 for each Monster HDMI cable purchased with an advertised bandwidth exceeding 10.2 Gbps and that is not a Monster Gold, Platinum or Black Platinum model cable;
- $13 for each Monster Platinum HDMI Cable purchased;
- $18 for each Monster Black Platinum HDMI Cable purchased.
Proof of purchase required: see below for acceptable forms of proof of purchase.
Option B (Monetary Payment and Replacement Cable):
- $15 for each Monster Gold HDMI Cable purchased;
- $15 for each Monster HDMI cable purchased with an advertised bandwidth exceeding 10.2 Gbps and that is not a Monster Gold, Platinum or Black Platinum model cable;
- $25 for each Monster Platinum HDMI Cable purchased;
- $35 for each Monster Black Platinum HDMI Cable purchased.
Proof of purchase required:
You must mail your existing HDMI cable to the Settlement Administrator. You will receive a 10.2 Gbps cable as well as postage reimbursement up to $5.00.
Option C (Monster Online Store Credit):
- $20 credit on Monsterproducts.com for each Monster Gold HDMI Cable purchased;
- $20 credit on Monsterproducts.com for each Monster HDMI cable purchased with an advertised bandwidth exceeding 10.2 Gbps and that is not a Monster Gold, Platinum or Black Platinum model cable;
- $25 credit on Monsterproducts.com for each Monster Platinum HDMI cable purchased;
- $30 credit on Monsterproducts.com for each Monster Black Platinum HDMI Cable purchased.
Proof of purchase:
None required if you submit only one claim under this Option.”
Proof of Purchase
Store credit requires no proof of purchase. To receive a cash award, Class Members must submit proof of purchase including receipt, credit card statement, or picture of the HDMI cable box.
