protein powder protein spiking false advertisingA new class action lawsuit alleges Barlean’s Greens Supplement Powders may not be as healthy as they are advertised based on the amount of lead allegedly in the product with no warning label.

Lead plaintiff Cory Brannon claims in his class action lawsuit that the makers of Barlean’s Greens Supplement Powders use false representations to tout the product to unwitting consumers interested in bettering their health.

In fact, says the plaintiff, Barlean’s products are actually bad for your health.

“Defendant labels and advertises the Products as, among other things, ‘NATURE’S PERFECT SUPERFOOD,’ a ‘Pathway to a better life,’ ‘Vegan Superfood,’ and as containing ‘Antioxidant Power,'” the Barlean’s Greens Supplement Powder class action lawsuit states.

“In addition, Defendant states on the label of the Products that they are a ‘premium superfood created to:’ ‘Support cleansing of organs and tissues’; ‘Super-Boost your health and ENERGY’; ‘Help improve digestion’; ‘Aid the body’s natural detoxification’; and ‘Promote a healthy immune system.’ Defendant also states that the Products are ‘superfoods designed to invigorate and nourish both your mind and body. Masterfully formulated with Nature’s most vitalizing plant-based ingredients…”

The plaintiff says that he and other health conscious consumers were duped into buying Barlean’s Greens Supplement Powders based on this advertising.

According to the Barlean’s class action lawsuit, “These uniform, material Representations are false and misleading because they are not substantiated, and therefore violate the Dietary Supplement Health and Education Act of 1994 (‘DSHEA’). In addition, the Representations are false and misleading because the Products contain lead, which is harmful, rather than beneficial, to a consumer’s health.”

Not only does the alleged false advertising mislead consumers, the amount of lead allegedly in the product with no warning label violates a California law, Proposition 65, which requires companies to disclose harmful substances in their products.

“At the time Plaintiff purchased the Product, Plaintiff did not know, and had no reason to know, that the Representations were misleading, deceptive and unlawful,” the Barlean’s supplement class action lawsuit states. “In addition, Plaintiff did not know, and had no reason to know that the Product contained lead. Nor did Plaintiff know, and had no reason to know, that the Product labels omitted the required Proposition 65 warning, and otherwise wholly failed to disclose the presence of lead in the Product. Plaintiff would not have purchased the Products, or would have purchased them on different terms, if he had known the truth.”

Brannon seeks to represent a nationwide Class of individuals who purchased Barlean’s Greens Supplement Powders, along with a California subclass. The plaintiff alleges that the makers of Barlean’s Greens Supplement Powder products are engaged in false advertising, breach of warranty, and are in violation of California advertising and consumer protection laws.

The plaintiff is seeking damages as well as a court order requiring the makers of Barlean’s Greens to cease and desist selling its allegedly misbranded products.
