An Uber class action lawsuit claims that the rideshare company sent spam text messages to rejected driver applicants violating federal law.

Plaintiff Danny Gesel Reznik Fridman claims that he applied for a job as a driver with Uber Eats in July 2017, but was rejected.

However, on April 21, 2018, Uber allegedly sent Reznik a text message intended exclusively for active Uber drivers.

Reznik states that Uber’s practice of sending text messages to rejected drivers violates the Telephone Consumer Protection Act (TCPA).

Allegedly, the text message that Reznik received contained the following text:

“Uber: Danny, your vehicle Insurance expires in 30 days. Once you get a new version of your document you can upload it here http://t.uber.com/expiry to keep your account active. Thanks!”

The Uber text message class action lawsuit claims that this text was intended only for active drivers but was sent not only to active users but to a nationwide list of telephone numbers of applicants who were rejected or denied, as well as to people who had never applied to be Uber drivers.

Reznik seeks damages on behalf of himself and all of the similarly affected recipients of the alleged spam text messages, as well as an award of statutory damages and costs.

According to Reznik, sending this text message en masse to a list of denied applicants violates the TCPA in a number of ways. Firstly, the TCPA prohibits businesses from contacting individuals via text messages with whom they do not have a standing business relationship.

The Uber class action lawsuit states that when Uber denied the applicants’ request for employment, it terminated any business relationship with the individual. So, the plaintiff claims that Uber was sending text messages to individuals with whom it did not have a business relationship, violating the TCPA.

According to the Uber TCPA class action lawsuit, to send the mass text messages, Uber may well have provided a third-party entity with access to applicant records, including phone numbers.

Reznik states that Uber also may have authorized the third-party to use the name “Uber” to send the messages. He says that Uber, or the third party, used an automatic dialing system to call thousands of numbers at one time.

The Uber text message class action states that the TCPA prohibits companies from calling or texting individuals using an automated dialing system, or a system that can dial many numbers at once, bothering many people. Reznik states that Uber’s practice of texting many denied applicants at once caused him and others emotional distress, irritation, lost time, loss of enjoyment of his phone, and other injury.

Reznik claims that the fact the text message he received was identical to those received by other rejected applicants, as well as by active drivers, shows that the text message was sent using an automatic dialer.

In addition to damages and monetary compensation, Reznik seeks an injunction that would require Uber to stop sending the spam text messages in violation of the TCPA.

The plaintiff is represented by Avi R. Kaufman of Kaufman PA.
