Saks-Fifth-AvenueA class action lawsuit claims that Saks Fifth Avenue, Lord & Taylor, and its operating business the Hudson’s Bay Company, didn’t sufficiently protect its consumer data, leading to a data breach that exposed the credit card information of millions of customers.

Plaintiff Antranik Mekerdijian alleges that his personal information, along with that of millions of other consumers of the stores Saks Fifth Avenue, Saks Fifth Avenue OFF 5th, and Lord & Taylor, was exposed in a data breach on or about May 2017.

He claims that Saks Fifth Avenue, the company behind the three brands, did not sufficiently protect its customers’ data and did not respond appropriately to the hack that exposed the consumer data.

According to the Saks Fifth Avenue class action lawsuit, Saks and its stores were hacked on or around May 2017 by the hacking syndicate JokerStash. On March 28, 2018, the syndicate announced that they had hacked the company in May 2017.

The Saks Fifth Ave data breach class action lawsuit alleges that the data breach was made possible by Saks’ lax security practices. The majority of the data stolen in the May 2017 breach was allegedly credit card information from the point of sale — information known as “dumps.” According to the Saks, Lord & Taylor data breach class action lawsuit, this type of information is valuable to those interested in consumers information, and can be easily sold for profit.

Mekerdijian claims that he was injured by the loss of his personal information, namely the loss of his payment card information. He says that his injury, namely financial injury, from the breach was beyond the direct financial ramifications of having fraudulent purchases made on his account. The plaintiff states that a repayment of funds lost from his account due to fraudulent charges would not be sufficient in making him whole again.

Allegedly, Mekerdijian feels the injury he incurred was in part due to the time and effort necessary in repairing the damage and fixing the problem of having his information stolen. He cites a study conducted by the Department of Justice’s Bureau of Justice Statistics which found that “among victims who had personal information used for fraudulent purposes, 29% spent a month or more resolving problems.”

The Saks class action says Mekerdijian and similarly affected consumers experienced extensive inconvenience in mitigating the harm done by the data breach and in protecting themselves from future exposure.

The Saks Fifth Avenue identity theft class action lawsuit claims that “the data breach was a direct and proximate result of [Saks’] failure to properly safeguard and protect [consumers’ personal information] from unauthorized access, use, and disclosure, as required by various state and federal regulations, industry practices, and the common law.”

The Saks data breach class action lawsuit goes on to state that the breach was a result of Saks’ “failure to establish and implement appropriate administrative, technical, and physical safeguards to ensure the security and confidentiality of [consumers’ information] to protect against reasonably foreseeable threats to the security or the integrity of such information.”

Lastly, Merekdijian claims that the company did not take sufficient action to notify him or other consumers about the data breach in a timely manner.

The plaintiff is represented by Bobby Saadian of Wilshire Law Firm.
