A nursing home neglect lawsuit was recently filed by a surviving adult daughter alleging her mother’s needs were repeatedly ignored and this negligence led to her wrongful death.
Plaintiff Michelle C. filed the nursing home neglect lawsuit on behalf of the estate of her deceased mother, Linda M., in Cabell Circuit Court.
The named defendant in the nursing home neglect lawsuit is Seventh Street Associates LLC, which does business as the elder care facility known as Huntington Health and Rehabilitation Center. The facility is located in Huntington, W.V.
According to an online article in the West Virginia Record, the plaintiff states that her mother resided at the care facility for four months between mid-September 2016 and Jan. 3, 2017—the date of her death. Among the allegations which the daughter brought forward in her nursing home neglect lawsuit were that the facility allowed her mother to develop pressure sores and an infection.
According to the narrative, Michelle through her counsel says that Linda M. developed colitis and eventually became septic.
The daughter is holding Seventh Street Associates LLC liable for their lack of adequate caregiving, monitoring, and supervision towards her mother over the four months of her residency at the facility.
Michelle is seeking a trial by jury and the maximum compensatory award allowed. She is also asking for all court and attorney fees to be included.
Nursing Home Neglect and Other Elder Abuse Statistics
Domestically, up to 5 million people over the age of 60 are subject to abusive or neglectful care situations either institutionally, or by family members every year. Often, signs which point to these conditions are missed entirely or never reported to authorities. This fact allows compromised care situations to continue.

Physical signs may be bruises, burns, abrasions, pressure sores, dehydration, body odor indicative of poor hygiene, broken bones, and sudden loss of weight without explanation.
