soldiers IED EFP attack Anti-Terrorism Act

If you were injured or a loved one was killed by a roadside bomb in Iraq or Afghanistan, you could be eligible to file an IED attack lawsuit.

IEDs and EFPs used during wars in Iraq and Afghanistan were often supplied by Iran, according to the Department of Defense. The origins of these weapons matter because the U.S. Congress placed sanctions on Iran to prevent the rogue state from instigating terrorist attacks or sponsoring terrorism. The sanctions were designed to restrict Iran’s finances, severely limiting the funding it needed to make and deploy weaponry.

Some of those affected by incidents resulting from this funding have filed IED attack lawsuits.

Iran convinced some financial institutions to assist in funding the creation and delivery of several different types of weapons used against Americans in Iraq and Afghanistan. Among the weapons:

IED – an Improvised Explosive Device is a bomb created and used outside the realm of any organized military formation. A timer or a remote control trigger is used to cause the IED to explode, allowing harmful metal fragments to propel at anyone nearby. Nails, nuts, and bolts are often packed into an IED, and these metal objects are thrown as shrapnel, injuring or killing nearby victims. Some IEDs make use of computerized parts from cell phones to exert more control over the timing of the explosion.

EFP – The Explosively Formed Penetrators were deemed “the most lethal weapon American forces faced in Iraq” by the New York Times. EFPs are armor-piercing weapons that could be hidden 100 yards or more away. They could be camouflaged as rocks or trash, and the sharp projectile could maintain its shape after detonation.

IRAM or RAM Improvised Rocket Assisted Munitions are propane tanks filled with explosives and are propelled by 107mm rockets. During the war in Iraq, these rocket-propelled bombs were often launched from the back of a truck and later deployed by a remote control-operated device.

IED Attack Lawsuit Would Hold Banks Responsible

Unfortunately, Iran found banks that assisted in financing the creation of IEDs and EFPs in exchange for exorbitant profits. These ill-gotten gains were not a secret for long. The U.S. has found these financial institutions, which have pled guilty and reached settlements with the U.S.

Banks that allegedly helped fund Iran’s weapons production and distribution efforts include HSBC of UK, BNP Paribas of France, and Commerzbank of Germany. These financial institutions have been held accountable in other IED attack lawsuits.

Affected servicemembers and veterans could be eligible for compensation by filing an IED attack lawsuit. Federal law specifically says:

Any national of the United States injured in his or her person, property, or business by reason of an act of international terrorism, or his or her estate, survivors, or heirs, may sue therefor in any appropriate district court of the United States and shall recover threefold the damages he or she sustains and the cost of the suit, including attorney’s fees. (18 U.S. Code § 2333)

The conspirators already have entered guilty pleas, admitting their wrongdoing. If you or a loved one was injured by an IED, EFP or RAM during the Iraq or Afghanistan wars, you could qualify to pursue an IED attack lawsuit.
