Primanti Corp. d/b/a Primanti Bros. and other related defendants have agreed to pay $2.1 million to settle a class action lawsuit alleging they failed to properly pay tipped employees as required under federal and state law.
If you worked at a Primanti Bros. restaurant between Sept. 9, 2013 and Dec. 31, 2016 as a bartender, food runner and/or server, you may be eligible for benefits from the tipped employee class action settlement.
According to the Primanti Bros. class action lawsuit, the defendants violated the federal Fair Labor Standards Act (FLSA), the Pennsylvania Wage Payment Collections Law and Pennsylvania common law.
Plaintiff Chelsea Koenig alleges that the Primanti Bros. defendants failed to satisfy the notice requirements of the tip credit provisions under federal and state law. She also claims the defendants violated applicable federal and state law by taking certain deductions from tips.
“Due to Defendants’ unlawful failure to properly inform Tipped Employees of its intention to utilize a ‘tip credit’, Defendants have improperly applied a ‘tip credit’ against the wages paid to Plaintiff and current and former Tipped Employees, thus paying them less than the mandated minimum wage,” Koenig alleged in the Primanti Bros. class action lawsuit.
Primanti Bros. denies the allegations and maintains that they paid tipped employees properly and that they provided proper notice of the tip credit.
The Primanti Bros. class action settlement was preliminarily approved on Jan. 17, 2018.
The deadline to opt out of or object to the Primanti Bros class action settlement is April 16, 2018.
Who’s Eligible
Class Members of the tipped employee settlement include anyone who worked as a bartender, server, and/or food runner at any Primanti Bros. restaurant in Pennsylvania, Ohio, West Virginia, Indiana, Maryland, and/or Michigan and were paid less than $7.25 per hour.
Potential Award
Varies, depending on several factors, including in which state the Class Member worked, the number of hours worked and the tip credit claimed by Primanti Bros.
It is estimated that Class Members will receive approximately 12.4 percent of the total wages owed during the Class Period. An estimate of the amount each Class Member is expected to receive is printed in the Notice Packet that was mailed to them. This amount may increase if not all eligible Class Members participate in the Primanti Bros. class action settlement.
