A settlement has been proposed in a class action lawsuit that alleges receipts provided by SeaWorld at the point of sale or transaction included the expiration date of customers’ credit and/or debit cards in violation of the Fair and Accurate Credit Transactions Act (FACTA).

If you were provided with an electronically printed receipt at a point of sale or transaction at SeaWorld between March 28, 2013 and April 1, 2017, and the expiration date of your debit or credit card number was printed on the receipt, you may be entitled to compensation from the SeaWorld FACTA class action settlement.

FACTA is a federal law that prohibits merchants from printing more than the last five digits of credit or debit card numbers or the payment card’s expiration date on a receipt issued at the point of sale. FACTA applies to all electronically printed customer receipts, including those issued at cash registers, self-service kiosks, and at restaurants.

The plaintiffs allege SeaWorld printed close to 1.3 million receipts that were in violation of FACTA during the Class Period.

SeaWorld denies the allegations but agreed to settle the FACTA class action lawsuit to avoid the burden, expense and uncertainty of ongoing litigation.

The SeaWorld FACTA class action settlement was preliminarily approved on Nov. 28, 2017.

Class Members who would like to opt out of or object to the SeaWorld FACTA settlement must do so no later than March 6, 2018.

Who’s Eligible

Class Members of the SeaWorld class action settlement include anyone who was provided by SeaWorld with at least one electronically printed receipt at a point of sale or transaction between March 28, 2013 and April 1, 2017 on which the expiration date of a personal credit or debit card was printed.

Potential Award

$25 for Class Members who submit proof of receipt or two concession certificates with a total value of up to $9.50 (up to $4.75 per certificate).

Proof of Purchase

None required. Class Members who submit a claim for the $25 cash payment must provide at least one qualifying receipt as documentation. No proof is required for Class Members who submit a claim for the concession certificates.

    I just received the concession voucher email as the first communication on this. The deadline to submit a receipt for settlement was back in March. Where was that communication?

    Pulling your bank statements will not help. They want a receipt to show proof that the expiration date of the card was actually printed on the receipt. A bank statement would not help with that.

    I received an email today stating I was an entitled Class Member since I had purchased something at the park within the time-frame given. Included was a Login Code and a link, which took me to claiming my two free popcorn vouchers which I have just printed out.

    Better than nothing, especially considering I had not been none the wiser prior to receiving the email! That credit card is probably long gone now anywho.
