Another person has come forward with a lawsuit against Unum, alleging that her ERISA disability claim was wrongfully denied by the insurance giant. According to this lawsuit — as well as a slew of others like it — Unum denied her valid ERISA disability claim, also denying her benefits to which she was entitled.
The plaintiff, Vikki S., worked for years with Starwood Hotels and Resorts Worldwide, Inc. Through her work with Starwood Hotels, Vikki was covered under an employee benefit plan from Unum Life Insurance Company of America, which included disability insurance.
After becoming disabled in June 2016 and therefore unable to continue her work for Starwood Hotels, Vikki filed her ERISA disability claim. However, she says that despite her valid claim, medical evidence, and continuing disability, the ERISA disability claim was denied. After exhausting all administrative claims and appeal possibilities, Vikki turned to litigation via the U.S. District Court for the District of Minnesota in October 2017.
According to her disability claim lawsuit, Unum’s denial of her ERISA disability claim was wrong, and at least part based in a conflict of interest. She points out that Unum funds the insurance plan, but also determines whether or not a person covered by the plan will receive benefits when they file a ERISA disability claim.
Filing an Unum ERISA Disability Claim Denial Lawsuit
A growing number of plaintiffs like Vikki are filing disability benefits lawsuits against Unum, claiming that the insurance giant unfairly denied their ERISA disability claim to benefits that they qualify for under the terms of their insurance policies, provided by employers.
This Unum ERISA lawsuit and others like it allege that Unum, the largest disability insurance company in the country, has unfairly denied the disability insurance claims of plaintiffs who are qualified to receive such benefits. Some lawsuits allege that the company purposely denied the claims of hundreds of thousands of workers with legitimate disabilities for no reason other than to increase company profits.
