Quorn-logo-Viewers of Top Class Actions report they’ve started to receive checks in the mail from a Quorn Foods false advertising class action settlement.

The Quorn Foods settlement benefits persons who purchased the Quorn Foods products at issue between Jan. 26, 2012 and Dec. 14, 2016.

Affected persons were able to claim a full refund. The total amount of relevant purchases was estimated to reach as high as $120 million.

According to comments and posts on the Top Class Actions Facebook page, viewers are receiving checks ranging between $100 to $975. If you filed a claim for the Quorn class action settlement, keep an eye on your mailbox because checks are on their way!

This settlement was the product of a Quorn Foods class action lawsuit filed in January 2016. Plaintiff Kimberly Birbower accused defendant Quorn Foods Inc. of falsely labeling its vegetarian meat-substitute food products in a way that would make consumers think they contained protein derived from mushrooms, truffles or morels. Quorn Foods identifies this protein product as “mycoprotein.”

In fact, Birbower claimed, Quorn Foods’ mycoprotein is derived not from mushrooms but from “fermented soil mold with added vitamins and flavors.” She accused Quorn Foods of purposely wording its labeling to deceive consumers into thinking they were purchasing a mushroom-based product, not a mold-based product.

Birbower alleged some consumers reported severe reactions linked with consumption of Quorn Foods products, including the death of one child in 2013. The company added an allergy disclosure to its labeling in 2015, a disclosure Birbower described as “intentionally buried” in the label’s text so that ordinary consumers would not read it.

In addition to making payments, Quorn Foods has agreed to make changes to its labeling and promotional materials for Quorn Foods products. The allergy disclosure will be modified to mention reports of allergic reactions related to mycoprotein, and it will be moved to a more prominent position on the products’ packaging.

Quorn also agreed to remove from its promotional materials the statement “There are believed to be over 600,000 varieties of fungi in the world, many of which are among the most sought after foods like varieties of mushroom, truffles, and morels.”

The settlement administrator began sending out settlement notices to prospective Class Members in February 2017 and accepted claims through the claim filing deadline of June 1, 2017. U.S. District Judge Dolly M. Gee granted final approval of the settlement on Sept. 11. The settlement administrator has since started mailing checks to qualifying Class Members.

Birnbower will receive a $5,000 incentive award for serving as Class representative.

    I suffered a severe reaction to Qorn in the spring of 2019. I was unaware of its history of causing allergic reactions (warnings on package remained very vague and buried), nor of the class-action settlement. Wish there were a second class-action lawsuit.
