Top Class Actions viewers are reporting that they have received checks for $45.78 from the Real Time Resolutions TCPA class action settlement.
Lead plaintiff Michelle Lee Tannlund alleged in her class action lawsuit that she and others received auto dialed messages from Real Time Resolutions about debt services.
The plaintiff claimed that she never provided consent to Real Time to send those messages, therefore the calls were made in violation of the Telephone Consumer Protection Act. Further, alleged the plaintiff, the customer service representative for Real Time she contacted to stop the calls was abusive and insulting, she said.
Real Time Resolutions settled the class action lawsuit by agreeing to pay $1.3 million to a Class of consumers who received the unwanted messages.
According to the Top Class Actions Facebook page, Class Members who filed valid claims for the Real Time Resolutions TCPA class action settlement began receiving checks for as much as $45.78 starting Oct. 21, 2017. If you filed a valid claim for this settlement, keep an eye on your mailbox because checks are arriving.
The TCPA prohibits companies from making unwanted calls and messages to consumers. It was enacted in 1991 to protect consumers from use of auto dialers and other electronic advertising unless they provide permission. Violations of the TCPA carry steep fines of up to $1,500 per violation.
Real Time did not admit to any violations of the TCPA when it settled, but said it wanted to avoid the expense and burden of further litigating the class action lawsuit. The class action alleged that Real Time Resolutions used a prerecorded voice and an auto dialer to contact consumers on their cell phones without their consent.
Class Members included “All living persons in the United States (1) who received a phone call from Defendant during the Class Period to a number assigned to a cellular telephone service at the time the call was made, (2) where the number was uploaded to and dialed by Defendant’s telephone system, and (3) who did not give his or her express consent prior to such call being placed.” The unwanted messages subject to the settlement occurred between Aug. 30, 2009 and April 10, 2017.
The award was estimated at $25, but the actual amount depended on the total number of Class Members who submitted valid claims. The deadline to file a claim passed on Aug. 23, 2017.
