California phone call recordingPlaintiff Yenon A. has filed a lawsuit in Florida federal court against ADT LLC, also known as ADT Security Systems, for violations of the Telephone Consumer Protection Act.

According to this ADT robocalls lawsuit, Yenon is a resident of the state of Florida, and ADT is a Delaware business entity.

Yenon complains that ADT began calling his cell phone using anautomatic telephone dialing system, or ATDS. The company may have also used an artificial or prerecorded voice.

The ADT robocalls lawsuit states that Yenon had spoken with a representative from the company and “revoked any consent” that ADT had to contatct him on his cell phone.

However, the calls continued. According to the ADT robocalls lawsuit, “once defendant was aware that its calls were unwanted, its continued calls could have served no purpose other than harassment.”

The ADT robocalls lawsuit maintains that ADT ignored the plaintiff’s request to revoke his consent to make any phone calls to his cell phone, then allowed the calls to continue.

The plaintiff is raising a claim against ADT for violations of the Telephone Consumer Protection Act. He also demands a trial by jury.

TCPA Robocalls Lawsuit Facts

The Telephone Consumer Protection Act, or TCPA, was enacted to help protect U.S. consumers from certain kinds of unwarranted and unsolicited messages and telephone calls. Violations of the Telephone Consumer Protection Act can be grounds for a TCPA class action lawsuit. Some of these actins have led to multimillion dollar settlements.

The TCPA was enacted in 1991 to help consumers from unwanted contact such as through telemarketers, text messages, robocalls, and autodialers.

It also created a National Do Not Call Registry. Individuals can put add their phone numbers to the registry in order to prevent telemarketers or solicitors from contacting them. Once a name has been added to the National Do Not Call Registry, telemarketers, solicitors, and any other company must permanently honor that request.

According to the TCPA, when calling consumers, a solicitor or telemarketer must provide information from where they are calling, and provide information such as their name, phone number, and address. In addition, they are prevented from making contact before 8 am or after 9 pm, and they are restricted in the ways they can use autodialers, artificial recordings or “robocalls.”

Due to these violations, consumers such as Yenon have filed lawsuits against these companies. Some plaintiffs have even been able to collect thousands and even millions of dollars against them.
