Current and former Rite Aid store managers may qualify for benefits under terms of a recent $5.5 million class action settlement.
This Rite Aid class action lawsuit was initiated in October 2008 by plaintiff Yatram Indergit. Indergit worked for nearly 30 years as a Rite Aid store manager in White Plains, N.Y. He alleged that he and other Rite Aid store managers were expected to work long hours of overtime without receiving additional compensation at the correct overtime rate.
Although Rite Aid store managers were salaried, Indergit argued that the nature of their work was such that they should qualify for overtime and minimum wage protections under federal and state law. Store managers often ended up performing the work of hourly Rite Aid employees, who were classified as non-exempt from employment law protections.
Yet Rite Aid still classified its store managers as exempt, denying them the higher overtime wage for overtime hours. As a result, Indergit claims, he sometimes had to work as much as 80 hours in a single week without being paid overtime compensation.
To settle these claims, Rite Aid has agreed to pay up to $5.5 million. These funds will be distributed to qualifying Class Members after first covering plaintiff’s service awards, attorneys’ fees, and other expenses. Individual payments will be determined according to the formula described on the settlement website.
Class Members who worked in states other than New York may receive benefits only if they already filed a consent to join this action. (New York Class Members are not subject to the same requirement.)
Rite Aid maintains there is nothing wrong with the way they compensate their store managers. The settlement does not require Rite Aid to admit any fault, and the court has made no decision on liability.
Class Members can object to the settlement’s terms or exclude themselves from the settlement by filing a written request by Oct. 10, 2017.
Who’s Eligible
There are two plaintiff Classes. Both Classes cover current and former salaried Rite Aid store managers who worked at a Rite Aid store, including stores that became Rite Aid stores during the relevant period.
The New York State Law Class covers those who worked in the state of New York at any time from Oct. 30, 2002 through the present.
The FLSA Class covers those who worked in any other state at any time from March 31, 2007 through the present and who previously filed a consent to join this case.
Potential Award
Varies.
Each individual award will be determined in part by the number of weeks the claimant worked for Rite Aid as a salaried store manager during either of the Class Periods.
Proof of Purchase
The settlement administrator does not ask for any other documentation besides the information requested on the Claim Form.

Still did not receive any money for all class actions ever. I’ve worked as store manager from 1997 to 2003.
I am still waiting for this check. I have worked for Rite Aid as a store manager from 1997 until 2009.

Still nothing…I was employed there in the covered time and claim forms mailed before deadline.

Only one person got a check. I believed the lawyer kept the money .
Scratch that. It was on the 10th.
Checks were mailed on the 5th. I received mine on the 11th due to the bad weather in my area.
