CITGO Petroleum Corporation Inc. has agreed pay more than $8 million to settle a class action lawsuit alleging it violated the Telephone Consumer Protection Act by sending text messages to cell phones without the recipients’ prior express written consent.
If you were sent one or more text messages from CITGO in 2016, you may be entitled to payment from the TCPA class action settlement.
According to the TCPA class action settlement documents, CITGO sponsored text-to-win sweepstakes contests between 2014 and 2016. These contests were promoted at concerts, sporting events, gas stations and theme parks.
Plaintiff Matthew Gottlieb says he entered two CITGO-sponsored sweepstakes contests on July 31, 2015 while he was attending a concert in West Palm Beach, Florida. More than a year later, Gottlieb started receiving text messages notifying him of other sweepstakes contests sponsored by CITGO, he alleges in the CITGO TCPA class action lawsuit.
Gottlieb claims he received a total of three text messages that promoted CITGO-sponsored sweepstakes contests. The CITGO class action settlement documents indicate that text messages similar to the ones Gottlieb received were sent to approximately 93,000 cell phone numbers of consumers who previously entered other CITGO-sponsored sweepstakes contests. These text messages were allegedly sent without the prior written consent of the text message recipients in violation of the TCPA.
The Telephone Consumer Protection Act is a federal law that prohibits certain types of telephone solicitations and the use of automated telephone equipment. Companies are also prohibited from sending text messages to cell phone numbers without the prior written consent of the recipient. Companies found in violation of the TCPA may be subject to statutory penalties ranging from $500 to $1,500 per violation.
CITGO denies the allegations but agreed to settle the TCPA class action lawsuit to avoid the burden and expense of ongoing litigation.

Me either
I never receive a check yet in new york city
I still didn’t receive anything.
I’M having problems Cashing the check I recieved. I don’t want to put it in my bank out of fear it’s not a legitimate check. No currency exchange or check cashing place will honor this check because it states on the check that it can’t be cashed at any check cashing place it must be cashed at a bank or credit union, although the FAQ says if you have a problem send the original check back and they will send you a replacement check without the legal restrictions. I complied with this and they sent a replacement check but it’s the same check they didn’t take off the restrictions.
How much was your check. Mr. Steele. You should have put it in the bank until it clear.
I have not received a check either!! I think we should get in touch with the judge!!
Dude put the check in your bank that is just to discourage people who don’t have banking accounts lmao….you legit right?
Will TCA lawyer let people no why we hadn’t gotten no check.
Please consider reporting their General Counsel to the Bar Association for withholding claims which is fraud. A lot of these companies are not paying out for legitimate claims and yet they make sure they’re paid first.
Here at TCA, we are not attorneys. You can try contact class counsel with your concerns about the settlement administrator. You can also write the judge on the case as well.
They did the same thing to me as well. My email is on auto-save to our hard drive. I received my claim verification email in September and nothing thereafter from the settlement administrators asking for further information. As I would have gladly followed up with everything I have, had they really sent follow-up emails as their letter yesterday indicated. This is after leaving a message asking for the status of my verified claim and sending through USPS.
I hadn’t received nothing yet. I saw a post on Facebook., A lady said she got her check for the amount they posted. I don’t understand why people checks are not sent out at same time.
has anyone gotten there check yet? Web says they were issued Feb 5. Nothing here yet
I’m being told they have not started sending out checks!
They giving everyone a different excuse…
I just contacted class counsel in Fl. See what happens now.
I cannot find a phone number, do you have it?
