unpaid-overtime-class-action-lawsuitA technician working for Cintas Corporate Services has filed an unpaid overtime class action lawsuit on behalf of himself and many others in a similar situation, alleging that Cintas failed to pay proper overtime wages.

The plaintiff is Mark Cassingham, a California resident who worked as a fire service technician at Cintas from January 29, 2016 through May 19, 2017. According to the unpaid overtime class action lawsuit, Cassingham and other Cintas technicians were not paid properly for their off-the-clock work, which they performed regularly.

Traveling to and from the day’s worksites and preparing paperwork before and after shifts were regular off-the-clock work for these employees, the lawsuit argues. But that time was not reimbursed at the time-and-a-half overtime rate required by California wage and hour law.

Class Members potentially eligible for this unpaid overtime class action lawsuit upon class certification include current and former Cintas technicians who worked for the company any time after Aug. 29, 2014 up through the lawsuit’s judgment.

The unpaid overtime class action lawsuit claims that Cintas violated both federal and state labor laws. The company’s failure to pay overtime violated the Fair Labor Standards Act and California law. Failure to pay minimum wage and failure to provide accurate wage statements violated California law.

Mark filed his unpaid overtime class action lawsuit on Aug. 28, 2017 in the U.S. District Court for the Northern District of California.

Wage and Hour Regulations

There are a series of both federal and state wage and hour laws put in place to protect workers and ensure they are treated fairly. However, many workers across the country do not know the protections that the Fair Labor Standards Act (FLSA) offers, which can lead to employers taking advantage of them.

Some workers may not be aware of FLSA rules. Others may be afraid that their employers will retaliate or even fire them if they speak up about these kinds of FLSA violations. To protect workers who help to enforce FLSA rules, laws also exist to protect workers from retaliation based on wage and hour complaints.

California overtime laws require that, if employees work more than 40 hours per week or more than 8 hours in a day, they are compensated with proper overtime pay. Overtime pay should be one and a half times that of regular work wages.

In California, there are penalties for failure to meet wage and hour laws, such as underpayment or unpaid wages, paying wages with insufficient funds, failure to provide meal or rest breaks, failure to provide one day’s rest in seven, failure to pay wages timely upon termination, and unlawful deduction of wages.
