Rock concert, crowd of young people enjoying night performance, raised up and clapping hands, dance club, bright blue lights, music entertainmentLive Nation Entertainment Inc. and Vivid Seats Ltd. are facing a Ticketmaster class action lawsuit alleging they failed to issue refunds to consumers who purchased concert tickets for Janet Jackson’s 2015 Unbreakable World Tour, which was rescheduled for yet-to-be-determined dates but never officially cancelled.

Plaintiff Tiana Adams says she purchased tickets for Janet Jackson’s Unbreakable World Tour, which was announced in May 2015. According to the Janet Jackson tickets class action lawsuit, Janet Jackson was to perform approximately 30 concerts during this tour, which was scheduled to begin in September 2015.

Adams says she visited the Vivid Seats website and purchased two tickets for Janet Jackson’s Anaheim concert, which was scheduled to take place on Jan. 16, 2016. According to the Unbreakable World Tour class action lawsuit, Vivid Seats is “a marketplace for individuals to purchase tickets to sporting events, concerts and theater events.”

After purchasing the concert tickets, Adams received a confirmation email from Vivid Seats and two electronic tickets from Ticketmaster, which is owned and controlled by Live Nation, the Ticketmaster refund class action lawsuit says. The tickets allegedly indicated that they were subject to the full terms found at the Ticketmaster website, which promised full refunds in case of cancelled events.

The refund policy listed on the Ticketmaster website for rescheduled events stated: “We’ll contact you with the new date and time ASAP. Can’t make it? Refunds are up to the artist, team, venue, or promoter – but we’ll do everything we can to help. Contact us!”

According to the Janet Jackson concert refund class action lawsuit, Vivid Seats had its own rescheduled event policy, which promised a full refund even if no rescheduled date had been set.

Adams says she was notified by Vivid Seats on Dec. 28, 2015 that the Anaheim Janet Jackson concert had been postponed to July 8, 2016. She was later notified that the tour had been postponed until 2017 but Vivid Seats did not provide her with a new date for the concert.

“Plaintiff has since contacted Vivid Seats multiple times, inquiring about a refund, only to be advised that because the Show has not been cancelled, Plaintiff cannot get a refund,” the Ticketmaster class action states.

Adams suggests that “Jackson’s conduct in postponing the Tour to 2017, without specific dates, reflects that Jackson is presently unaware when, if at all, she can complete the Tour.”

Adams initially filed the Janet Jackson ticket refund class action lawsuit on April 18 in the Superior Court of California for the County of Riverside. It was removed to the U.S. District Court for the Central District of California on July 25.

The Ticketmaster class action lawsuit was filed on behalf of Adams and a proposed Class of individuals in the United States who purchased one or more tickets sold or distributed by Ticketmaster to at least one show from Janet Jackson’s Unbreakable World Tour that have been rescheduled.

Adams believes there are at least 18,000 potential Class Members.

The Ticketmaster class action lawsuit asserts violations of the Consumer Legal Remedies Act and Section 17200 of the California Business and Professions Code, which prohibits unfair and unlawful business practices.
