walmart rollbackWalmart is facing a class action lawsuit that purport the company’s “Rollback” sale pricing is deceiving and dishonest as the cutbacks are not even based on original prices.

A California woman is challenging the alleged false original prices that Walmart bases its Rollback prices upon.

Plaintiff Brenna C. seeks to represent a Class comprised of all individuals who had purchased products based on the advertised Rollback prices at Walmart advertised with an original price that did not in fact accurately match the actual price for the item. The proposed Class includes individuals who purchased such products between April 20, 2017, and the final date of judgement for the lawsuit.

Allegedly, Rollback prices at Walmart are based off fake original prices. Consumers are made to believe that they are cutting back on the costs of products when they are actually paying for the product’s original price.

The lawsuit alleging deceptive rollback prices at Walmart was filed in April. Brenna claims that the retail giant uses a sale scheme to disadvantage and deceive “price-conscious shoppers.”

Specifically, the plaintiff claims the retail giant falsely constructs and states deceptive prices of original products that were low-priced to increase their revenue and profits.

The Walmart class action lawsuit alleging the deceptive rollback prices at Walmart states that “prominently displayed directly above the purportedly ‘rolled back’ items, with express references to former ‘was’ prices that never existed and/or did not constitute the prevailing market retail prices.”

The lawsuit shows pictures depicting the price tags for both the original store product price and the store’s Rollback price. In some pictures, the Rollback price and the posted original price appear to be the same.

Moreover, the depictions had also showed that the original or “was” price tag is higher than the price that is being shown, and that the reported Rollback price is allegedly the exact same to the original purchase price of the item or product.

“Such pricing comparisons were false and deceptive because the marketed, advertised, warranted, and represented former or ‘was’ price were fabricated and did not represent [Walmart]’s true former, usual or original retail prices for the purportedly discounted items,” the complaint states.

Brenna says that making such allegedly false advertisements and inaccurate prices induce consumers to make item or product purchases that they would not ordinarily otherwise make.

According to the lawsuit, the plaintiff is asking Walmart to discontinue its alleged deceptive “rollback” pricing and advertising campaign. She is further asking for damages, reimbursement of attorneys’ fees paid, restitution and disgorgement, and costs for litigation.
