Justice Stores Tween BrandsClass action settlement money has been mailed to Ohio consumers who shopped at Tween Brands retail stores, also known as “Justice” stores, and were allegedly misled by deceptive sale prices.

Justice stores sell clothing for “tween” girls between the ages of 10 and 13.

Top Class Actions viewers are reporting to us on our Facebook page and on our Open Class Action Settlement article that they received settlement checks worth $12 or more, depending on whether they submitted store receipts for proof of purchase. The checks were mailed on July 13, according to an update on the Settlement Administrator’s website.

The Justice store class action settlement resolves allegations that Tween Brands Inc. violated Ohio law, which allows stores to advertise a “sale price” on items only if they were sold at a higher, regular price for at least 28 days in the previous 90 days.

According to the class action lawsuit (Marian Perez v. Tween Brands Inc.), items at Ohio Justice stores were sold at a higher price so infrequently that the 40-percent off price actually reflected the regular price of the items.

Tween Brands denies that it violated the law, but agreed to settle the class action lawsuit to avoid the uncertainty, risk and expense of litigation.

The Justice sale price class action settlement was preliminarily approved on Jan. 23, 2015. U.S. District Judge Richard Collins granted final approval to the deal on May 8.

The deadline to file a claim was June 8, 2015.

Class Members who submitted receipts substantiating their purchases within the Class Period were eligible to receive a refund of 20 percent of their total purchases, minus any returns.

Class Members who did not submit receipts substantiating their purchases could elect to receive either a cash payment of $12 or a coupon for 40-percent off any total purchase at any Ohio Tween Brands retail location.
