Plaintiffs Thomas Knox and Convention Center Parking LP, both property owners in Philadelphia’s Center City, are challenging the property tax assessment methods used by the City of Philadelphia and its Center City District, both of whom are named defendants.

The plaintiffs claim this property tax regime results in disparate treatment of property owners who successfully get the assessment of their property value reduced on appeal. Based on those reductions, the Center City District refunds overpaid taxes to some property owners but not to others, the plaintiffs say.

The Center City District is a public entity charged with managing public space improvements and enhancing economic development in downtown Philadelphia. Its activity is funded by mandatory assessments levied on taxable property within the District, assessments that are paid by the property owners.

According to this Center City District class action lawsuit, the existing taxation method violates the District’s enabling statute and provisions of the Pennsylvania and U.S. constitutions.

Plaintiffs say that by assessing property taxes based on artificially high values, the Center City District exceeds its statutory authority. And by treating property owners differently without a valid reason to do so, the District is violating both the uniformity clause of the state constitution and the Equal Protection clause of the U.S. Constitution, the plaintiffs argue.

Convention Center Parking says it got the city-assessed value of its Broad Street property reduced by over $2 million for tax years 2014 through 2016. Yet the Center City District failed to tax the company at the correct rate for those tax years, the company claims.

Knox says the city’s property tax assessment overvalued his condominium. He successfully appealed that assessment, and the city lowered that valuation by almost $1 million. But even after that appeal, he claims, the Center City District refused to lower its own valuation of his condominium and refused to refund the taxes he overpaid based on the higher assessment.

Knox and Convention Center Parking blame the Center City District’s “notice policy,” which requires property owners to submit a chain of paperwork to the District if they want the District to recalculate their taxes based on the city’s new, lower property assessment.

The proposed plaintiff Class in this Center City District class action lawsuit would cover all property owners who won a reduced assessment of their property value on appeal to the City of Philadelphia and to whom the District did not return excess money based on the higher assessment, and who remain subject to the higher assessments by the Center City District from 2014 through the present.

They are seeking a court declaration that the Center City District’s past use of anything but the reduced assessments in determining property values had been unlawful. They also seek an award of damages, restitution, court costs and attorney’s fees.

    Again I apologize for the grammatical errors in the above statement . written on my ipad , therefore it has a mind of its own when I hit published .

    First of all, want to start a a class action suit fir all Philadelphian honeowners and myself , for the cost of the move and storage fees,. Secondly, sherriffs department were deceitful and lied/bullied, and handle homeowners in a unprofessional manner for us to Vacate our homes.

    In the end, I, like many Philadelphian homeowners bare witness, and have proof of the deceptive use, and lack of interest that City Hall had displayed helping homeowners to stay/ keep their homes!

    Secondly, our city like many, are corrupt, and have no interest in the people. From taxation system, like the sugar tax in Philadelphia pa .etc etc

    Thirdly, Mortgage litigations! No success record helping homeowners. So many homes went up for Auction! We are one the highest in record , people losing their homes in this city!

    Furthermore, it keeps getting worst for Philadelphians, many, many, business, are struggling, from this Sugar tax law, ex etc Unions laid off so many Philadelphians because of our Wonderful Man that calls himself a Mayor! Again, Sugar Tax Law

    I , personally stopped by his offices,emailed him few times.. And, What I received in response.? “Sorry This office cannot help You”. That’s it

    In the end, Philadelphia homeowners lost their homes, And now,let’s put them out of business,too! Anything else ? Oh there’s plenty more. Property Tax assessment
    Should I keep going Philadelphia???

    I was bullied and deceived by Philadelphia Sherriffs department to vacate my home. They had used methods that were unethical and deceived many homeowners in Philadelphia pa I will sue and gather many Philadelphians into class action suit!

    Philadelphia pa. Has been caught on many allegations and corruptions. I have been trying to get attention n fight city hall in issues. Example : I had lost my home over city talks corruption. I have saved emails that I had go sent to our MAyor, Judges, and courts,about the scam and siding with the banks. I fought for seven years on my own! Eventually I became tired and list my home!

    Secondly, Class Action law suit I want to start , how the sheriffs department handle all Philadelphia homeowners to vacate their property!

    Thirdly, I know a person whom retired from that department , and secretly, let me know how this sheriffs office is corrupt and pay- offs are used to bully and deceived the homeowners of
    Phila Pa. to vacate their Prooerty, or go to jail. Used imtiatidation, and lies etc.

    Lastly, And, Most importantly, Our United States Constitutional God Given Right . I’m going to forward my two page story to every media who wants The truth, who will listen! So many honeowners were scammed and Mislead by the sheriffs department .
