home-depot-logoAn Ohio couple claims Home Depot has been illegally performing construction and general contracting services without a license.

Plaintiffs Frances and Dennis Hido claim that defendant Home Depot USA Inc. has been deceiving Ohio homeowners by offering general contracting services in that state.

In fact, the Hidos claim, Home Depot has not satisfied any of the licensing and bonding requirements necessary to operate as a general contractor in Ohio.

According to the Hidos, Home Depot’s corporate registration with the Ohio is solely for the purpose of “[o]peration of Retail Home Improvement Stores.” They say the company has made no effort to seek licensing to perform construction services or to operate as a general contractor.

The Hidos say they hired Home Depot to complete a kitchen renovation project in their home in Sagamore Hills, Ohio, paying the company tens of thousands of dollars. Home Depot subcontracted the work – which they say included electrical, drywall, carpentry, cabinet installation, and other work – to one or more subcontractors.

But because Home Depot is not licenesd and bonded as a general contractor, the Hidos claim, their renovation project flew under the radar of local government inspectors.

“As a result of never obtaining licensing or permits, Home Depot’s work goes uninspected. Governmental building departments do not know what to inspect because they are unaware of the projects,” the Hidos allege.

“Electrical, plumbing, and other significant construction is thus never performed in a code-compliant manner, and potential dangers, including electrical or plumbing dangers that could be life-threatening dangers, remain hidden and unnoticed,” the Home Depot class action states.

The Hidos claim that without proper licensing, Home Depot has been illegally holding itself out as a general contractor. They argue the company cannot legally accept payment for contracting work without the proper licensing and permits.

Among other claims, the Home Depot class action lawsuit raises claims for breach of contract and for violation of the consumer protection laws of Ohio state and Summit County.

The Hidos are proposing to represent a statewide plaintiff Class that would include all Ohio property owners who bought remodeling or property improvement services from Home Depot that involved Home Depot providing services on an Ohio property for which the company was not registered or licensed, or for which the company did not apply for a building permit before beginning the work.

They also propose subclasses that would cover Class Members who purchased such services for their residential property. The plaintiffs estimate that Class Members could number in the hundreds and possibly thousands.

They are asking the court for an order nullifying any further obligations between Home Depot and the Class Members and requiring Home Depot to return to the Class Members all money collected for construction or renovation projects that required either a permit or registration when Home Depot had neither. They also seek an award of actual damages, court costs and attorneys’ fees, all with pre- and post-judgment interest.

    I had my roof replaced by Home depot in 2017. Just had an independent roofer look at my gutters and he took photos of the warped and sagging roof in many spots and told me they didnt replace the plywood underneath and the shigles were cracked.. He said the whole roof needs to be stripped off and all replaced. I had spots in my second floor celing that were never there until i got a new Home Depot roof.
    Nor was a permit ever mentioned to me.
    Are there any class action lawsuits on Home Depot i can join ?

    I’ve hired home depot in Florida to replace my roof in 2018, and 2 months later I’ve had leaks everywhere in the house, I could not believe it, 2 months later after they have replaced my entire roof, that was incredible!! I’m not done yet when I called home depot to come and have checked my roof leaks, they took for 5 months to have someone to look at it.
    I would not recommend home depot at all to do any type of job in your property !!

      Home Depot literally makes me sick. I hired them almost 4 years ago to do my kitchen. To this day it isn’t finished! Doors are wrapped, uneven, the refacing has been cracked off. No back splash. I’ve been living out of boxes all this time. It’s time for them to pay for all the damage they have caused to all of us. This project is near $40,000.00. I’m just sick!! They don’t actually send contractors to do the work, they mostly send kids in their 20s to do some of the work. Workers sent here had no license. They said it was through Home Depot!! Stay away from Home Depot!!

    Wow, we were just having problems with Home Depot as we requested a copy of a business license and Certificate of Insurance from one of their companies to install window treatments. They could provide neither.
    Bad business practice!

    I think there should be a action suit against Home Depot because there so called contractors are not licensed. I still have not seen a license and it took 4 months to get windows and siding installed. I am not pleased with them at all. I DO NOT RECOMMEND Home Depot for anything. I was told i would receive a gift card and it was in the mail,I guess it got lost that was 4 1/2 weeks ago.

    I had a set of french door’s installed off of my bedroom and there was a two inch gap left at the bottom where the doors meet and I can literally see through it. Rain comes through and is so does cold air and it doesn’t seal out the hot air either!! Messy contractor work. I complained to Home Depot at time of service and the contractor’s they came back out, looked at it and said that that’s as good as it’s going to get. And there was nothing they could do about it.!!

      We are in Florida and had hurricane windows installed – we have had nothing but rain coming inside and a whole wall that subsequently has to be replaced. The french doors we ordered were also not what we got as they bought the wrong doors.
      What a sorry company Home Depot is!!

    I have had all new windows installed and almost all of them leak air around the sides from the screws being too tight. And a lack of caulk around all windows. The aluminum wrap is all buckling and showing all the wood that it is sopost to have covered up…. Poor poor workmanship on everything. When I called they said they would send some one out but they never did…

      I had hurricane windows installed throughout the house. Home Depot hired contractors (if they are contractors) and we have water damage due to the leaky windows. The whole wall is damaged and we have been emailing them and calling them and they tell us they will fix it but it has been almost a year. Also the wrong windows were put in and we have had nothing but a headache. This was supposed to protect my family and instead we have bees and bugs getting through the window and a ruined wall.
      We haven’t been able to alarm our house bc the doors were put in incorrectly.
      I am at a loss in words to convey my hardship.

    PROBLEMS WITH AMERICAN HOME SHIELD (HOME WARRANTY) SERVICE ?
