The Minnesota resident alleges the insurance company denied her right to long term disability coverage and that the insurance company did not give her claim a fair and full review.

Plaintiff Genoveva D. is filing this Unum disability insurance lawsuit, alleging Unum acted in bad faith and did not perform its civil duty in properly evaluating her disability claim.

According to the Unum disability insurance lawsuit, Genoveva had been previously fully employed by Costco Wholesale Corporation and was supposed to be provided insurance coverage in case of disability. Before she became disabled, Genoveva had been fully able to perform her occupational duties and was able to work a full time schedule.

However, she became disabled on Nov. 7, 2013 and has since been unable to work or earn a sufficient income, she claims. Under the Unum disability plan that was supposed to be provided through her Costco employment, Genoveva was eligible for long term disability coverage.

More specifically, Genoveva says she lost a significant amount of income and had no way to work in a similar occupation. Along with these factors, Genoveva further proved her disability by submitting medical testimony by her physician when she filed her claim.

According to her Unum disability insurance lawsuit, Unum initially approved Genoveva’s claim for disability coverage and paid her until March 28, 2016. However, just several days later on June 9, 2016, Unum abruptly canceled Genoveva’s disability coverage.

Genoveva immediately tried to appeal this decision, but was denied by the disability insurance giant. Her Unum disability insurance lawsuit states the disability insurance company had previously acknowledged that Genoveva was disabled, but now denies this fact.

Overview of Unum Disability Claim Denial Tactics

It is important to note that during the entire claim submission process, Genoveva filed all procedure instructions and had also filed any relevant medical testimony that proved her disability.

In addition Genoveva also says she filed for appeal in a timely manner, also with relevant medical testimony. Genoveva’s physician reportedly communicated with Unum representatives, but she claims Unum rejected the professional’s opinion.

Genoveva is filing this Unum disability insurance lawsuit alleging the company used a number of improper tactics to find reason to deny her claim. These alleged claim denial tactics included:

  • Relying on an unreliable biased opinion from a third party
  • Relying on faulty medical evidence
  • Relying on specific portions evidence that would work against the claim

Genoveva has exhausted all administrative remedies, and is seeking all missing disability payments along with any additional interest.
