Kellogg is facing yet another lawsuit over it’s not-so-fruity Froot Loops. The class action lawsuit was been filed against Kellogg USA for selling its Froot Loops cereal with pictures of brightly colored cereal made to resemble fruit and pictures of actual fruit, even though Froot Loops “contains no nutritional fruit whatsoever.”This will be the fourth time someone has tried to sue Kellogg over its fruit-less Froot Loops. Previous lawsuits claimed the “Froot Loops” name misled consumers by causing them to believe the product contained “real, nutritious fruit.” These claims have been rejected twice by federal judges who ruled the word “Froot” cannot reasonably be interpreted as meaning there is real “fruit” present, and that the ring-shaped cereal doesn’t resemble fruit at all. The third lawsuit, which was filed by the same plaintiff as the current lawsuit, was dismissed because Kellogg wasn’t properly served.If approved, the class action lawsuit will require Kellogg to cease misrepresenting its cereal as containing nutritious fruit and refund class members an unspecified amount of damages.
