puritans-prideA class action lawsuit against Puritan’s Pride vitamins, herbs, and other supplements alleges that the company’s “buy one get one free” marketing scheme is false and misleading.

The complaint states that Puritan’s Pride Inc. and The Nature’s Bounty Co. routinely sell their products by telling consumer that “for a limited time,” if they purchased one or more products they could get additional items for “free.”

However, according to the class action these statements are deceptive: “consumers did not receive any ‘free’ Products because the cost of those Products were built into the price of Products that the consumer was purchasing.”

In addition, the complaint asserts that these offers have been available for the past four years, and thus the timing of these promotions was not “limited.”

“Defendants engage in the above systemic and continuous practices of disseminating false, deceptive, and misleading information about the Products via an extensive and comprehensive nationwide marketing campaign, consisting of, inter alia, internet postings, blast emails, targeted emails,” and other media, according to the complaint, which is, “intended to induce unsuspecting consumers, including Plaintiffs and members of the Class, into purchasing millions of dollars worth of Puritan’s Pride branded Products at a premium price.”

The Puritan’s Pride class action lawsuit cites several examples of the defendants’ marketing. The complaint contains screen shots of the Puritan’s Pride website, with “Buy 1 Get 2 FREE” prominently displayed. Also, sample products such as Double Strength Glucosamine, Chondroitin & MSM Joint Soother is advertised as being “30% off” and “on sale” with a “Buy 1 Get 2 Free” offer. The class action contends that this advertising is misleading under California consumer protection laws, because defendant’s products are permanently “on sale” and therefore nothing was actually free.

Plaintiffs Meg Larson and Diane Cabrera, residents of California, both state that they purchased numerous Puritan’s Pride products online. Larson says that her most recent purchase was in September of 2016. Larson claims that she always made purchases under a “buy one get one free” or “buy one get two free” offer. Similarly, Cabrera says she also purchased multiple products from Puritan’s Pride with “buy one get one free” offers, most recently in May of 2016.

“Plaintiffs and members of the Class would not have believed that they were obtaining the same value for their purchases had they known that the price for purchased Products included the price for the purportedly ‘free’ Products, such that they were not receiving a deal or price reduction at all,” the class action argues.

The Puritan’s Pride lawsuit requests certification of a Class of all California residents who purchased Puritan’s Pride products in the past four years. The class action seeks restitution and an injunction stopping defendants from their unlawful marketing.
