MusclePharm class action lawsuitMusclePharm Corp. is facing a class action lawsuit alleging it deceptively markets its glutamine supplement as beneficial to human health.

However, according to plaintiff Nick Yeldo, glutamine supplements have been found to be ineffective at mimicking the benefits provided by glutamine that is naturally found within the human body.

According to the MusclePharm supplement class action lawsuit, glutamine that is naturally found within the body supports important mechanisms such as muscle growth, recovery and immunity.

However, scientific studies reportedly show that glutamine supplements do not have these same benefits, Yeldo argues.

“Simply because a substance, such as glutamine, is a nutrient, does not necessarily mean that its enhanced use is beneficial,” the MusclePharm supplement class action lawsuit alleges.

The MusclePharm Glutamine supplement reportedly includes the following claims on its label: “Enhance Muscle Growth & Recovery” and “Faster Recovery.” The website includes further claims about the MusclePharm Glutamine supplement, including: “Aid in Muscle Growth,” “Reduce catabolism and support an anabolic environment,” and “Minimized muscle catabolism (breakdown).”

Yeldo claims that the MusclePharm Glutamine supplements are “completely ineffective” at mimicking the health benefits and physiological processes that are supported by glutamine that is naturally found in the body. According to the MusclePharm class action lawsuit, all of the claims on the product website and label have been shown through scientific studies to be false and misleading.

“Simply put, the ingestion of Defendant’s Product does absolutely nothing for the recovery from exercise, recovery of muscle tissue, enhancement of muscle or ability to decrease muscle wasting (anti-catabolic),” the MusclePharm supplement class action lawsuit states.

Yeldo says he and other putative Class Members were misled by MusclePharm’s representations about the efficacy of its glutamine supplements, which in many cases were found to be no more effective than a placebo, according to the MusclePharm Glutamine supplement class action lawsuit.

Even though MusclePharm is aware that the claims made on its glutamine supplement are misleading to consumers, Yeldo claims the company continues to manufacture, label, advertise, distribute and sell its glutamine supplements in a deceptive manner. He says that the lack of benefits provided by the MusclePharm supplement diminishes the actual value of the product.

Yeldo filed the MusclePharm class action lawsuit on behalf of himself and a nationwide Class of consumers who purchased the MusclePharm Glutamine supplement in the last six years. He also seeks to represent a subclass of Michigan consumers who purchased the product.

The MusclePharm Glutamine class action lawsuit asserts claims for breach of express warranties, breach of implied warranties, negligent misrepresentation, intentional misrepresentation and unjust enrichment.

Yeldo is seeking actual damages, punitive damages, attorneys’ fees and costs, pre- and post-judgment interest, and other relief deemed appropriate by the court.
