GameStop Sued Over ‘Deceptive’ Used Game Advertising

Video game retailer GameStop has been slapped with a class action lawsuit that claims the company uses “deceptive and misleading” practices to get people to buy used video games. Several games, including “Dragon Age Origins,” “Mass Effect 2,” “Battlefield: Bad Company 2,” “NBA Live ’09” and “Rock Band 2,” are packaged with free downloadable content, such as codes for new levels, weapons and songs. Used copies of these games are also packaged as having free content, even though consumers have to pay an additional fee in order to access it.
According to the class action lawsuit, “GameStop is aware of this issue and continues to fail to alert customers that this content is not available on used games. As a result, GameStop tricks consumers into paying more for a used game than they would if they purchased the same game and content new.”
The lead plaintiff, for example, bought a used game for $5 less than a brand new copy, yet ended up paying an additional $15 to access the downloadable content. In the end he paid $10 more than if he had simply bought a new copy with the same content.
