Amazon Prime class action lawsuitAmazon.com LLC has been hit with a class action lawsuit filed by a woman who says the online retail giant failed to cancel an Amazon Prime membership that was charged to her bank account without her authorization.

Plaintiff Latoya Christmas says that her debit card was used without her consent to purchase goods from Amazon.com in September 2016. The same card was used to sign up for a $99 Amazon Prime membership, the Amazon class action lawsuit states.

On Sept. 29, 2016, Christmas reportedly called Amazon to notify the company that unauthorized purchases had been charged to her debit card. She requested cancellation of the Amazon Prime membership. According to the Amazon.com class action lawsuit, Amazon agreed to cancel the Amazon Prime membership and refund the $99 fee to Christmas’ debit card.

Christmas believes that Amazon would have continued to take additional unauthorized recurring payments from her bank account if she had not called to cancel the Amazon Prime membership, even though she had never provided Amazon with consent to deduct funds from her account on a recurring basis.

The next day, Christmas says Amazon withdrew another $99 from her bank account for a recurring Amazon Prime membership. She immediately called Amazon to have the charges refunded, but the retailer failed to refund the money, the Amazon class action lawsuit alleges.

According to the Amazon class action lawsuit, Amazon “concealed, suppressed and/or omitted” the fact that Christmas’ bank account would be debited another $99 annual membership fee even though she had cancelled the Amazon Prime membership.

Christmas claims she never provided Amazon.com with any authorization to deduct the Amazon Prime membership fee from her account. According to the Amazon class action lawsuit, she did not provide the retail giant with any written or electronic communication that authorized these recurring payments.

By filing the Amazon Prime class action lawsuit, Christmas seeks to represent herself and a Class of consumers whose bank accounts were debited by Amazon after Amazon had received a cancellation request for the Amazon Prime membership. She also seeks to represent an Illinois subclass.

The Amazon.com class action lawsuit asserts violations of the Electronic Funds Transfer Act and the Illinois Consumer Fraud and Deceptive Business Practices Act.

“In multiple instances, Defendants debited bank accounts of the Class and the Sub-Class members on a recurring basis after the consumers requested to stop payments of preauthorized electronic fund transfers from the consumers’ accounts by notifying the financial institutions orally or in writing at least three business days before the scheduled date of the transfers, in violation of the EFTA,” the Amazon class action lawsuit states.

Christmas is seeking statutory damages of $1,000 per violation of the EFTA, actual and punitive damages, attorneys’ fees and costs, and other relief deemed appropriate by the court.

    I’ve contacted them several times about the same unauthorized withdrawals from my account. I was told the couldn’t give me any information but someone else is authorized to use my account. I informed them I’m the only person authorized to use my account any money taken out of that account other than my prime membership does not have my authorization.

    I am overly upset, Amazon has been charging me a prime fee for service I do not have, nor did I ask for.
    They deducted 3 payments out , which all 3 times they said they would refund, never did. I closed the account. I then had to redo all my bills because I had to receive another card. Headache. I purchase some books , I said no to prime, paid $5.99 fir shipping. A month later a charge for prime. Called on yes we will send you your money never did.
    Now are charging my new account, and attempts to charge the old one as well… I get text and emails stating Amazon is trying to charge on a closed account. I expect better from a company that is very well known. Please somebody contact me… it is really sending up my stress leve.

      They are doing same thing to me. October 31, 2022 I found a charge on my Chase credit card for A monthly fee for Amazon prime membership that I did not sign up for. my wife has a prime membership and My amazon account is link to her prime account as a family member . I just discovered that they did it again March 4, fraudulently charging me a monthly fee for a prime membership that I never signed up for. What proves that this is not accidental is the fact that they’ve done it twice, 4 months apart. also ,I already have a prime membership through my wife so it’s clear that it’s not accidental in any way shape or form. they’re trying to defraud consumers by signing them up for a second membership. I don’t think there’s any benefits to having two prime memberships

    My father in law ordered something at my home on my amazon account. About 6 months later, Amazon decides to charge his card for my Prime membership. I only found out about this because Amazon told him who I was. Which is good that I found out but bad if you look at it as a security standpoint. So not only did they break security policies but they made it look like I stole money from my Father In Law. Every Attorney I talk to wont help me. This is not about the money, this is about making Amazon pay for crimes they commit like the rest of us.

    I’ve gone through this 3 times now with my mom’s Amazon account. She didn’t place a single order for over a year yet in that time she would randomly get charged for an Amazon Prime membership. I go through the hassle of getting a refund & a few months later there’s another unauthorized charge.
    I want to sue. She doesn’t really care because she doesn’t understand how I’ve spent hours of my time dealing with Amazon customer service. Can anything really be done about this?

    Amazon continues to charge me for digital services I have not ordered. On multiple occasions, I have asked Amazon to cancel my account. Amazon has agreed to cancel my account but has not done so. I currently live in Ecuador and am not able to cancel my account by going to the Amazon website because the website does not recognize recognize my computer at its new location. The Amazon website will only provide an access code to my old telephone number in the United States, which is no longer active. The Amazon website will not provide an access code to my e-mail address. I have called Amazon’s customer service department to update my telephone number so that I can get the required access code but Amazon refuses to do so. With this being the case, I am unable to cancel my Amazon account and I continue to be billed for Amazon digital services I have not ordered and do not want. I wish to be part of a class action lawsuit to stop Amazon’s unfair trade practices.

    They told me someone must be using my info and setting up accounts I don’t know about, but when I removed all credit cards from my account the charges curiously ceased. Hmmm…..
