What is a Syngenta GMO Corn Class Action Lawsuit?

During the 2011 year, Syngenta began marketing their Viptera GMO corn containing the MIR 162 genetically modified trait to numerous farmers across the nation. Although the Viptera corn seed was approved to be used in the United States, China and several other nations that import U.S. corn had not given their approval to this GMO corn.

Because of this lack of Viptera approval, China tested a U.S. corn shipment and discovered the presence of the MIR162 corn seed in November 2013 and rejected all U.S. corn imports.

A year later, China finally gave approval to Syngenta’s Viptera corn seed. However, corn trade between the U.S. and China have not yet resumed. As a result, many farmers and farming companies have filed Syngenta GMO corn class action lawsuits, alleging that the loss of the export market in China has resulted in a severe U.S. corn market loss and caused corn farmers to sustain heavy economic damages.

Plaintiffs further claim that the lack of China’s Viptera approval and the subsequent rejection of U.S. corn shipments resulted in overall lower corn prices for U.S. farmers.

Who are the Plaintiffs in this Syngenta Corn Lawsuit and What Do They Claim?

Numerous farmers and others involved in the U.S. corn industry are suing Syngenta. This includes Cargill, Archer Daniels Midland (ADM), and other corn exporters.

The plaintiffs in these Syngenta GMO corn class action lawsuits claim that Syngenta prematurely released the Viptera corn seed before China’s approval, thus hurting the U.S. corn market and corn producers.

According to studies by the National Grain and Feed Association, the estimated loss to the U.S. corn industry totals anywhere from $1 billion to nearly $3 billion. For corn seed producers and farmers, the study estimates they will sustain an economic loss of 20 to 30 cents per bushel of corn.

In the Syngenta GMO corn class action lawsuits, farmers and corn producers contend these corn seed losses will continue until corn exportation with China resumes.

What If I am Corn Farmer, But Do Not Grow Viptera?

The loss of China as a U.S. corn exporter has decreased the demand for U.S. corn all around the globe, which in turn caused a drop in the U.S. corn market price for all corn seed types and varieties.
