Hardwood and tile floorDue to the high volume of Lumber Liquidator class action lawsuits that have been filed and are expected to be filed, some plaintiffs have moved to consolidate all false advertising class action lawsuits concerning the potentially cancerous laminate flooring into a multidistrict litigation. Lumber Liquidators’ cheap laminate flooring allegedly contains unsafe levels of formaldehyde.

Lumber Liquidators Formaldehyde Dangers

Lumber Liquidators is the largest seller of hardwood floors in the country. While most of their product appears to be up to code, their cheap laminate flooring allegedly contains extremely high levels of formaldehyde, a carcinogen, leading to consumers filing Lumber Liquidators class action lawsuits.

Formaldehyde has been connected with multiple forms of cancer and can also lead to non-cancerous side effects. Signs of formaldehyde exposure may include irritation in the eyes, nose, and throat, headaches, nausea, or other symptoms.

Some Lumber Liquidators’ laminate flooring comes from China. This means that the hardwood laminate flooring can contain levels of formaldehyde which do not meet U.S. health and safety standards.

It has been alleged that Lumber Liquidators’ laminate flooring contains more than six or seven times the amount of formaldehyde that is legal to use in the United States, particularly California where the samples were tested. Some laminate samples were found to have as much as 20 times the legal amount, potentially putting a large number of homeowners at risk if they installed hardwood laminate flooring.

Lumber Liquidators in the Media

Awareness of this potentially deadly issue came from”60 Minutes” report, which was aired on CBS at the beginning of March. Over 150 boxes of Lumber Liquidators laminate flooring were tested. All were samples from California though the company is national.

It was found that only the cheap laminate flooring made in China contained unsafe levels of formaldehyde. All other flooring was found acceptable.

Other samples were tested across the nation, and the results were the same. The hardwood laminate flooring contained significantly higher levels of the carcinogen than is legal and safe.

Lumber Liquidators Lawsuits

So far, at least 10 Lumber Liquidators class action lawsuits have been filed against the retailer. All have claimed that the company is guilty of fraud and of breaking consumer protection laws.

Such cheap laminate flooring has been used in hundreds of thousands of homes across the country. This puts countless individuals allegedly in danger of developing cancer due to the formaldehyde levels in the flooring.

With the number of Lumber Liquidators lawsuits increasing, some plaintiffs have suggested that they all be combined into a laminate flooring MDL in the U.S. District Court for the Northern District of California. Arguments are expected to be heard on May 28, 2015 in Minneapolis.
UPDATE: Several Lumber Liquidators class action lawsuits wereconsolidated into a multidistrict litigation(MDL), or mass tort, and transferred to a Virginia federal court by the U.S. Judicial Panel on Multidistrict Litigation (JPML), alleging that the flooring company sold wood floors containing toxic levels of formaldehyde.UPDATE 2: On Oct. 24, 2017, Lumber Liquidators agreed to a $36 million settlement
