Disability insuranceTexas resident Yvonne R. recently filed a lawsuit against Unum Life Insurance Company of America. The disability insurance lawsuit alleges that Unum unfairly refused to pay Yvonne’s disability claim.

Unum is a major disability insurance provider in the United States, providing insurance to over 17 million Americans. According to statistics, nearly 40 percent of disability insurance polices are overseen by Unum or one of its subsidiaries.

According to the Unum claim denial lawsuit, Yvonne was an employee of Herring Bank, where as part of her employment she was provided with long term disability benefits and life insurance coverage with Life Waiver of Premiums Benefit. Unum was the insurance company that issued both policies.

Yvonne alleges that, while covered by the Unum insurance policies, she suffered from a medical condition that prevented her from performing the tasks necessary for her job. According to Yvonne, even though she met all the disability requirements contained in her long term disability policy, Unum denied her benefits.

Yvonne appealed Unum’s initial decision to deny her benefits within the insurance agency, but her appeal was unsuccessful. Yvonne is now asking the Texas District Court to review the decision. The Unum disability insurance lawsuit claims that Unum’s denial of benefits was wrong and that the company failed to provide the necessary information for Yvonne to effectively appeal the decision.

Yvonne’s Unum lawsuit asks the district court to order Unum to pay Yvonne the employee benefits she was denied up to the time of trial and to reinstate her policy for future payments.

Overview of Unum Lawsuits

Thousands of claim denial lawsuits have been filed against Unum due to their claim denial policies. These Unum lawsuits have been filed by the federal government, state regulators, and private citizens.

The CBS News program “60 Minutes” first uncovered Unum’s deceptive practices back in 2002. According to the news program, Unum sets a claim-denial quota each month for their claim adjusters. Claim adjusters who meet their quota are rewarded for meeting their goals.

These allegations were supported by several physicians employed by the insurance company. These past employees claim that Unum told the physicians to falsely claim that certain individuals were not disabled so the company could deny policy holders their benefits.

Disability insurance lawsuits are being filed by individuals who were allegedly denied valid disability claims from companies such as Unum Group, Unum Provident, Unum Life Insurance Company of America, John Hancock Financial, Metropolitan Life Insurance, and many more.

These disability lawsuits arise out of the Employee Retirement Income Security Act of 1974 (ERISA). ERISA is federal law that regulates most voluntarily established pension and health plans within the private industry. ERISA is intended to provide protection for the individuals who take part in these plans. One way ERISA provides consumer protection is by granting consumers the right to sue companies who violate these federal laws.
